Common use of Customer Election Clause in Contracts

Customer Election. Seller agrees and acknowledges that a Customer may elect to participate in or withdraw from Seller’s Portfolio at any time during the Delivery Term. Notwithstanding the prior sentence, changes to the Seller’s Portfolio shall not alter the Commitment Level designated by Seller in Table 3.2.1 for each Product. Customer Participation in or Withdrawal from Seller’s Portfolio. Seller shall submit to Buyer a form indicating Customer’s participation in or withdrawal from Seller’s Portfolio as provided in Appendix V (“Seller’s Notice to Add or Delete Customers Participating in the AMP Program”), which shall identify the Service Agreements to be included in the Seller’s Portfolio and shall be executed by authorized representatives of both Seller and Customer and Seller shall provide the executed forms to Buyer.
