Customer Defects Clause Samples

Customer Defects. If Customer notifies Upland of a problem and Upland correctly determines that the problem is due to Customer’s incorrect or improper use of the Application or failure to comply with the Standard Support Terms or the MSA (as opposed to a Defect in the Application), the resolution of such problem is not covered by Upland’s Support Services. However, Upland may provide Professional Services to address or cure the problem in accordance with the terms of the Agreement.
Customer Defects. ▇▇▇▇▇ shall have no obligation to repair or address any Problem that is due to Customer’s incorrect or improper use of the Supported Software or failure to comply with the terms of this Agreement. Customer Defects. If Customer notifies Alchemy of a problem and Alchemy correctly determines that the problem is due to Customer’s incorrect or improper use of the Software or failure to comply with the terms of this Agreement (as opposed to a Defect in the Software), the resolution of such problem is not covered by the Support Services. However, at Customer’s request in writing approving the fees therefore, Alchemy may provide Consulting Services to correct the problem pursuant to Section 3.4 above.
Customer Defects. If Customer notifies Iternal of a problem and Iternal correctly determines that the problem is due to Customer’s incorrect or improper use of the Solutions or failure to comply with the terms of this Support Agreement or the SaaS Rider (as opposed to a Defect in the Solutions), the resolution of such problem is not covered by Support. However, Iternal may provide consulting services to correct the problem pursuant to this Section 6.
