Current Products. Proposals shall be for materials and equipment in current production and marketed to the general public and education/government agencies at the time the proposal is submitted.
Current Products. All products offered in response to this solicitation will be in current and ongoing production; will have been formally announced for general marketing purposes; will be a model or type currently functioning in a user (paying customer) environment and capable of meeting or exceeding all specifications and requirements set forth in the City’s solicitation.
Current Products. If there have been Net Sales of any product prior to or on the Effective Date, there shall be no royalties due to Supernus for any Net Sales of such product made after the Effective Date. For the avoidance of doubt, this Section 4.10 refers to all units of such product no matter when produced or sold.

AT&T understands and agrees that Seller provides no indemnification for intellectual property claims arising from AT&T's purchase, use, or resale of Products included on Exhibit A as of the Closing Date, or which fall within the scope of the indemnification provisions of Article 9 of the Purchase and Sale Agreement. Seller agrees that it will promptly notify AT&T if it becomes aware of any claim or threatened claim that any such Product infringes the intellectual property rights of a Third Party, and will render any reasonable assistance that AT&T may request in investigating or defending such a claim.

Current Products. Vendor represents and warrants that, as of the Effective Date, Exhibit A contains all products offered by Vendor in the United States within a Product category covered by this Agreement. Upon receipt of notice from HealthTrust that Vendor is not in compliance with this Section 2.11.1, Vendor will have thirty (30) days to execute an amendment to add the product to Exhibit A at a price point or discount comparable to other Products under this Agreement. If Vendor fails or declines to add the product within such thirty (30) day period, then HealthTrust, in its sole discretion, may immediately terminate this Agreement.
Current Products. Contractor shall keep all products being offered under the Contract: (a) in current and ongoing production; (b) in its advertised product lines; (c) as models or types that are actively functioning in other paying customer environments; and (d) in conformance to the requirements of the Contract.
Current Products. The parties stipulate and agree that the prices for each Current Product shown on Schedule 2.2(a) shall remain in effect, regardless of any variation in the actual cost of raw materials or other costs, with respect to Products shipped by Coty before the close of business on June 30, 2007. Not later than May 1, 2007, Coty shall provide Ascendia with a revised price list, which shall be effective with respect to Products shipped by Coty from July 1, 2007 through June 30, 2008.
Current Products. For the term of this Agreement, Danka shall, or shall cause Danka Affiliates to, use the ordering process set forth on Exhibit 4 hereto, to order for purchase and purchase Products from NexPress pursuant to the terms and conditions set forth in this Agreement; provided, however, that the parties shall periodically meet to negotiate in good faith any alternative ordering process as may be appropriate from time to time.
Current Products. Prior to the Effective Date, the parties have developed Products for use in the Blood Screening Field, including Blood Screening Assays and Blood Screening Instruments. The Blood Screening Assays developed prior to the Effective Date are: the duplex Blood Screening Assay for HIV-1 and HCV; the Ultrio Assay Product, the Ultrio Plus Assay Product, and the WNV Assay Product. The Blood Screening Instruments developed prior to the Effective Date are: the ESAS Instrument, the ESAS2 Instrument, and the Tigris Instrument.
