Common use of Cumulation of Remedies Clause in Contracts

Cumulation of Remedies. Subject to any other express provision of the Agreement to the contrary, no remedy for a breach of any provision of the Agreement which is conferred by any provision of the Agreement is intended to be exclusive of any other remedy which is otherwise available at law, by statute or otherwise. Each remedy shall be cumulative and in addition to every other remedy given hereunder or now or hereafter existing at law, by statute or otherwise. The election of any one remedy by any Party shall not constitute a waiver by such Party of the right to pursue any other remedy.
