Common use of Credit Investigation Clause in Contracts

Credit Investigation. Each Lender acknowledges that it has made its own independent credit decision and investigation and taken such care on its own behalf as would have been the case had the Advances been made directly by such Lender to the Borrower without the intervention of the Agent or any other Lender. Each Lender agrees and acknowledges that the Agent makes no representations or warranties about the creditworthiness of the Borrower or any other party to this Agreement or with respect to the legality, validity, sufficiency or enforceability of this Agreement, any Loan Document, or any other instrument or document delivered hereunder or in connection herewith.
