Common use of Coverage Exclusions Clause in Contracts

Coverage Exclusions. 3.5.3.1 Except as provided in Section 3.5.3.2 of the Contract below, the Contractor must exclude coverage for the following: 3.5.3.1.1 Any drug or device marketed by a manufacturer who does not participate in the Medicaid Drug Rebate Program; 3.5.3.1.2 Any drug, device, or classes of drugs listed in Section 1927(d)(2)(B), (C), (H), or (K) of the Social Security Act; 3.5.3.1.3 All DESI drugs, as defined by the FDA; and 3.5.3.1.4 Drugs that are life style drugs or are not Medically Necessary.
