Covenant Defeasance and Waiver. Upon the Company’s exercise of the option described in Section 402(3) of the Indenture with respect to the Notes, in addition to the other obligations permitted to be released by Section 402(3), the Company shall be released from its obligations to comply with any term, provision or condition under Sections 3.01, 3.02 and 3.05 of this Ninth Supplemental Indenture with respect to the Notes. The provisions of Sections 3.01, 3.02 and 3.05 of this Ninth Supplemental Indenture may be waived in accordance with Section 1005 of the Indenture.

Covenant Defeasance and Waiver. Upon the Company’s exercise of the option described in Section 402(3) of the Indenture with respect to either the 2019 Notes or the 2044 Notes (or both the 2019 Notes and the 2044 Notes), in addition to the other obligations permitted to be released by Section 402(3), the Company shall be released from its obligations to comply with any term, provision or condition under Sections 3.01 and 3.02 of this Sixth Supplemental Indenture with respect to the Notes for which such option has been exercised.
