Common use of Counterparty Clause in Contracts

Counterparty. The possession, directly or indirectly, of power to direct or cause the direction of man- agement or policies (whether through ownership of securities or other ownership inter- ests, by contract or otherwise). A third party (which for the purposes of this Agreement includes a liquidity provider and Affiliate of Customer and/or User) with whom Customer and/or User carries on business using the Service.
