Common use of Cost Pools Clause in Contracts

Cost Pools. Landlord shall have the right, from time to time, to equitably allocate some or all of the Direct Expenses for the Project among different portions or occupants of the Project (the “Cost Pools”), in Landlord’s reasonable discretion. Such Cost Pools may include, but shall not be limited to, the office space tenants of a building of the Project or of the Project, and the retail space tenants of a building of the Project or of the Project. The Direct Expenses allocable to each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable manner; provided, however, Landlord may include retail space leased by office tenants of the Project within the office Cost Pool.

Such Cost Pools may include, but shall not be limited to, the office space tenants of a building of the Project or of the Project, and the retail space tenants of a building of the Project or of the Project. The Direct Expenses allocable to within each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable manner; provided, however, Landlord may include retail space leased by office tenants of the Project within the office Cost Pool.

Such Cost Pools may may, for example, include, but shall not be limited to, the office space tenants of a building of the Project or of the ProjectBuilding, and the retail space tenants of a building of the Project or of the Projecttenants. The Direct Operating Expenses and/or Insurance Expenses allocable to each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable manner; provided, however, Landlord may include retail space leased by office tenants of the Project within the office Cost Pool.

The Direct Expenses allocable to within each such Cost Pool shall be allocated to such Cost Pool and charged to the tenants within such Cost Pool in an equitable manner; providedmanner in accordance with generally accepted accounting and management practices, however, Landlord may include retail space leased by office tenants of the Project within the office Cost Poolconsistently applied.
