Controlling Documents. This Agreement (including all addenda and schedules and exhibits hereto and all documents and materials referenced herein) supersedes any and all other agreements, oral or written, between the parties hereto with respect to the subject matter hereof, and sets forth the complete and exclusive agreement between the parties with respect to the Services and, unless specifically provided for herein, other services are not included as part of this Agreement. If there is a conflict between the Bank Card Merchant Agreement and an addendum or schedule or exhibit hereto, the addendum or schedule or exhibit shall control. If there is a conflict between the Rules Summary and this Agreement, the Rules Summary shall control. If there is a conflict between Operating Regulations and this Agreement, the Operating Regulations shall control. If there is a conflict between the Operating Regulations and the Rules Summary, the Operating Regulations shall control.

Controlling Documents. The Site Plan is hereby incorporated herein by reference and made a part of this Agreement. There shall be strict adherence to this Agreement and the Site Plan, subject to minor modification by the City Manager in his discretion, as same may be amended from time-to-time in accordance with the procedures set forth in the City’s Zoning and Land Development Code or this Agreement. In the event that the Site Plan or any portion thereof is found to be in conflict with this Agreement, this Agreement shall control.

Controlling Documents. In the event any of the terms and provisions of this Attachment C to the COMPANY Master Services Agreement are contrary to or conflict with any other terms and conditions of any other Attachments to the Master Services AGREEMENT including Attachment B, then the terms and conditions of this Attachment C Agreement shall at all times supersede and control.

Controlling Documents. To the extent that the provisions of the Plan of Reorganization, the Merger Agreement, the Tax Matters Agreement, the Amended and Restated Split Participant Agreement or the Interim Transition Services Agreement or the Transition Services Agreement (whichever is in effect at the applicable time) conflict with the provisions of this Agreement, the provisions of such other agreement or agreements shall govern.

Controlling Documents. While the Participant’s election to make pre-tax contributions to pay for one or more Benefit Options may be made pursuant to this Plan, the Benefit Options will be provided not by this Plan but instead by the respective benefit plans or programs constituting the Benefit Option. Such benefit plans or programs, if and as implemented and in effect from time to time, shall be set forth in written instruments or in insurance policies or contracts which shall be filed with or attached as appendices or schedules to the Welfare Plan. The types and amounts of benefits available under each available Benefit Option, the requirements for coverage and receiving benefits under the Benefit Option, and the other terms and conditions pertaining thereto, shall be as set forth in the written instruments or in the insurance policies or contracts comprising the respective plans or programs.

Controlling Documents. In the event of a conflict between this Contract, the regulations, policies, or procedures published by Residence Life & Housing or Facilities, the Student Guide to University Policies will control.

Controlling Documents. To the extent that the provisions of the Tax Sharing Agreement, Employee Matters Agreement, Transitional Services Agreement, Manufacturing Agreement or Intellectual Property Assignment and License Agreement conflict with the provisions of this Agreement, the provisions of such other agreement shall govern.

Controlling Documents. 646 The governing documents of the conduct of the FIDO Alliance shall be, in order of supremacy, its 647 Articles of Incorporation, its Bylaws, the most recent versions of this Agreement and any other 648 Policy Document as approved by the Board and published on the Membership portion of the 649 FIDO Alliance website. 650 Where the above documents do not specifically address an issue, then the most recently published 651 version of ▇▇▇▇▇▇▇ Rules of Order shall be the controlling document.

Controlling Documents. The terms and conditions of the Program and the Plan are incorporated herein by reference, made a part hereof, and shall control in the event of any conflict with any other terms of this Award Agreement.
