Contractor's Liability Insurance. Contractor shall purchase and maintain such insurance as will protect Contractor from claims set forth below which may arise out of or result from the Contractor’s operations under the Contract, whether such operations be by Contractor or by any subcontractor or by anyone directly or indirectly employed by Contractor, or by anyone for whose acts any other may be liable: 1. Claims under Worker’s Compensation, disability benefits, and other similar employee benefit acts; 2. Claims for damage because of bodily injury, occupational sickness or disease, or death of his employees, and claims insured by usual personal injury liability coverage; 3. Claims for damages because of bodily injury, sickness or disease, or death of any person other than his employees; 4. Claims for damages insured by usual personal injury liability coverage which are sustained (1) by any person as a result of an offense directly or indirectly related to the employment of such person by the Contractor, or (2) by any other person; 5. Claims for damages, other than to the Work itself, because of injury to or destruction of tangible property, including loss of use resulting therefrom; and 6. Claims for damages because of bodily injury or death of any person or property damage arising out of the ownership, maintenance, or use of any motor vehicle. Insurance covering claims for damages to persons or property required above shall be in the amounts stipulated by Hastings: Bodily Injury Liability Each Person: $2,000,000.00 Each Accident or Occurrence: $2,000,000.00 Property Damage Liability Each Accident or Occurrence: Aggregate: $2,000,000.00 $2,000,000.00 and shall be furnished in the types specified, as follows:

The policies of insurance so required by this paragraph 5.04 to be purchased and maintained shall: 1. Insurance covering claims for damages with respect to persons insurance required by paragraphs 5.04.A.3 through 5.04.A.6 inclusive, include as additional insureds (subject to any customary exclusion in respect of professional liability) OWNER, ENGINEER, ENGINEER's Consultants, and any other individuals or property required above entities identified in the Supplementary Conditions, all of whom shall be listed as additional insureds, and include coverage for the respective officers, directors, partners, employees, agents, and other consultants and subcontractors of each and any of all such additional insureds, and the insurance afforded to these additional insureds shall provide primary coverage for all claims covered thereby; 2. include at least the specific coverages and be written for not less than the limits of liability provided in the amounts stipulated Supplementary Conditions or required by Hastings: Bodily Injury Liability Each Person: $2,000,000.00 Each Accident Laws or Occurrence: $2,000,000.00 Property Damage Liability Each Accident Regulations, whichever is greater; 3. include completed operations insurance; 4. include contractual liability insurance covering CONTRACTOR’s indemnity obligations under paragraphs 6.07, 6.11, and 6.20; 5. contain a provision or Occurrence: Aggregate: $2,000,000.00 $2,000,000.00 endorsement that the coverage afforded will not be canceled, materi- ally changed or renewal refused until at least thirty days prior written notice has been given to OWNER and shall be furnished CONTRACTOR and to each other additional insured identified in the types specifiedSupplementary Conditions to whom a certificate of insurance has been issued (and the certificates of insurance furnished by the CONTRACTOR pursuant to paragraph 5.03 will so provide); 6. remain in effect at least until final payment and at all times thereafter when CON- TRACTOR may be correcting, as follows:removing, or replac- ing defective Work in accordance with paragraph 13.07; and 7. with respect to completed operations insurance, and any insurance coverage written on a claims-made basis, remain in effect for at least two years after final payment (and CONTRACTOR shall furnish OWNER and each other additional insured identified in the Supplementary Conditions, to whom a certificate of insurance has been issued, evidence satisfactory to OWNER and any such additional insured of continuation of such insurance at final payment and one year thereafter).
