CONTRACTOR’S ACCEPTANCE Sample Clauses

CONTRACTOR’S ACCEPTANCE of Final Payment under this Agreement, shall constitute a full and complete release of Owner from any and all claims, demands, and causes of action whatsoever that the Contractor, its Subcontractors, including suppliers and consultants, or any of their successors or assigns have or may have against Owner arising from the Project or any provision(s) of this Agreement except for those previously made in writing and identified by Contractor as unsettled at the time of the Request for Final Payment.

CONTRACTOR’S ACCEPTANCE. CONTRACTOR agrees to receive and accept the prices shown on Exhibit "A," which is attached hereto and incorporated by reference herewith, as full compensation for furnishing all materials and equipment and for doing all the work described in the contract documents; also for all loss or damage as provided in the contract documents in the prosecution of the work until its acceptance by the Town Council of the TOWN OF LOS GATOS, and for well and faithfully completing the work, and the whole thereof, in the manner and according to the contract documents, plans and specifications, and the requirements of the Town Engineer.

CONTRACTOR’S ACCEPTANCE. 19.1 Licensee shall observe and abide by, and shall require Licensee’s Contractors to observe and abide by the terms, conditions and provisions set forth in this Agreement. Prior to any commencement of work under this Agreement by Licensee’s Contractor, Licensee shall require Licensee’s Contractor to execute and deliver to Licensor the Contractor Acceptance form attached hereto as Schedule A to acknowledge Licensee’s Contractor’s agreement to observe and abide by terms and conditions of the Agreement.

CONTRACTOR’S ACCEPTANCE. To and for the benefit of CSX Transportation, Inc. (“CSXT”) and to induce CSXT to permit Contractor on or about CSXT’s property for the purposes of performing work in accordance with the Agreement dated , 2023, between the Town of Apex and CSXT, Contractor hereby agrees to abide by and perform all applicable terms of the Agreement, including, but not limited to Exhibits C and F to the Agreement, and Sections 3, 9 and 11 of the Agreement.

Contractor: By: Name: Title: Date: This INTERLOCAL AGREEMENT BETWEEN PINELLAS COUNTY AND THE CITIES OF BELLEAIR BLUFFS, CLEARWATER, DUNEDIN, LARGO, AND SEMINOLE FOR FUNDING MATCH OF A SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT (SWFWMD) COOPERATIVE FUNDING INITIATIVE (CFI) GRANT TO CONDUCT A NUTRIENT SOURCE TRACKING STUDY (“AGREEMENT”) is entered into this day of , 2020, by and between PINELLAS COUNTY, a political subdivision of the State of Florida (“COUNTY”), the CITY OF BELLEAIR BLUFFS, a municipal corporation (“BELLEAIR BLUFFS”), the CITY OF CLEARWATER, a municipal corporation (“CLEARWATER”), the CITY OF DUNEDIN, a municipal corporation (“DUNEDIN”), the CITY OF LARGO, a municipal corporation (“LARGO”), and the CITY OF SEMINOLE, a municipal corporation (“SEMINOLE”), together collectively known as “PARTNERS.”

CONTRACTOR’S ACCEPTANCE. To and for the benefit of CSX Transportation, Inc. (“CSXT”) and to induce CSXT to permit Contractor on or about CSXT’s property for the purposes of performing work in accordance with the Temporary Right of Entry Agreement dated , 20 , between the TOWN OF MUNSTER, INDIANA and CSXT, Contractor hereby agrees to abide by and perform all applicable terms of the Agreement, including, but not limited to CSXT Insurance Requirements to the Agreement, and Sections 1, 2, and 10 through 12 of the Agreement.

CONTRACTOR’S ACCEPTANCE. CONTRACTOR agrees to receive and accept the prices shown on Exhibit “A” $249,490 and up to $24,949 in change orders, which is attached hereto and incorporated by reference herewith, as full compensation for furnishing all materials and equipment and for doing all the work described in the contract documents; also for all loss or damage as provided in the contract documents in the prosecution of the work until its acceptance by the Town Council of the TOWN OF LOS GATOS, and for well and faithfully completing the work, and the whole thereof, in the manner and according to the contract documents, plans and specifications, and the requirements of the Town Engineer.

CONTRACTOR’S ACCEPTANCE. Notwithstanding any other provision of this Agreement to the contrary, this Agreement shall not be binding upon Contractor unless accepted by Contractor, as evidenced by its signature. Until such acceptance, it constitutes an offer, which shall be irrevocable for a period of ten (10) days from the date signed by the City. In the event that Contractor fails to accept this Agreement within the ten (10) day time period, the City shall be entitled to a refund of any portion of the CDBG Funds paid to Contractor.
