CONTRACTOR EVALUATIONS. The designated Government representative is required to complete an Interagency Mobile Shower Facility Services Performance Evaluation Form (See Section J, Form 1276-F) prior to leaving each incident or prior to team transitions. The designated Government representative is required to distribute the completed copies of the evaluation as instructed on the form. (Do not send copies of the evaluation form to the Albuquerque Service Center). The form, in addition to other performance information which may become available, will be utilized to facilitate the Contractor’s annual performance report. The CO will provide the Contractor 30 calendar days to respond to any negative performance information received.
CONTRACTOR EVALUATIONS. A. The Contractor, by entering the Construction Contract, consents to the evaluation of its performance by the Department and/or the Department’s designee and understands that any such evaluation may be used in future procurements to determine Contractor’s responsibility. The Department and/or the Department’s designee shall provide the Contractor with written notice of any unsatisfactory evaluations and the reasons therefore. Contractor shall be entitled to submit a reply.
CONTRACTOR EVALUATIONS. CalRecycle will evaluate the Contractor’s performance within sixty days of the completion of this Agreement and shall remain on file by CalRecycle for a period of thirty-six months. If the Contractor does not satisfactorily perform the work or service specified in this Agreement, CalRecycle will submit a copy of the negative evaluation to the Department of General Services (DGS), Office of Legal Services, within five (5) working days of the completion of the evaluation. Upon filing an unsatisfactory evaluation with the DGS, CalRecycle shall notify and send a copy of the evaluation to the Contractor within fifteen days. The Contractor shall have thirty days to prepare and send a written response to CalRecycle and the DGS. CalRecycle and the DGS shall file the Contractor's statement with the evaluation. (PCC §10369).

In addition, this Contract is subject to any additional restrictions, limitations or conditions established by the United States Government and/or the State of California, or any statute enacted by the Congress and Legislature, which may affect the provisions, terms or funding of the Contract in any manner. The parties mutually agree that if the Congress and/or Legislature does not appropriate sufficient funds for the program, this Agreement shall be amended to reflect any reduction in funds.
CONTRACTOR EVALUATIONS. Pursuant to PCC Sections10367 and 10369, each contractor providing consultant services of $5,000 or more shall be advised in writing on the standard contract that the performance will be evaluated. One Contract/Contractor Evaluation, form STD 4, must be prepared within 60 days of the completion of the contract. The form shall be uploaded into FI$Cal and kept as part of the procurement file. The agency shall document the performance of the contractor in doing the work or in delivering the services for which the contract was awarded. The evaluations shall remain on file by the agency for a period of 36 months. If the contractor did not satisfactorily perform the work or service specified in the contract, the agency conducting the evaluation shall place one copy of the evaluation form in a separate agency contract file and send one copy of the form to DGS/OLS within five working days of the completion of the evaluation. (SCM Volume 1, section 3.02.5) On filing an unsatisfactory evaluation with DGS/OLS, the state agency shall notify and send a copy of the evaluation to the contractor within 15 days. The contractor shall have 30 days to prepare a statement defending his or her performance under the contract and to send it to the agency and the department. The contractor's statement shall be filed with the evaluation in the agency's separate contract file and in DGS/OLS's files. The evaluations and contractor responses on file with the agencies and DGS/OLS are not public records; they should be maintained in a separate file.
