Common use of Contracting Body's Obligations Clause in Contracts

Contracting Body's Obligations. Any Contracting Body ordering the Services under this Framework Agreement through a further competition may: adopt criteria set out in paragraph 2 of Schedule 6 (Award Criteria) when developing its Statement of Requirements for the Services and identify the Suppliers capable of supplying the Services; refine the Call-Off Terms to reflect its Services Requirements; or invite tenders by conducting a further competition for its Services Requirements and in particular: if an Electronic Reverse Auction (as defined in paragraph 4) is to be held the Contracting Body shall notify the relevant suppliers and shall conduct the further competition in accordance with the procedures set out in paragraph 8. If an Electronic Reverse Auction is not used, the Contracting Body shall: Invite the Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body’s Statement of Requirements (a ”Statement of Work”) and invite the Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework supplier; Set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and Keep each tender confidential until the time limit agreed by the Parties has expired; apply the criteria set out in paragraph 2 of Schedule 6 (Award Criteria) to the Suppliers’ compliant tenders submitted through the further competition as the basis of its decision to award a Call-Off Agreement for its Services Requirements; on the basis set out above, award its Services Requirements by placing an Order with the successful Supplier in accordance with paragraph 6 which: states the Services Requirements; states the statement of work submitted by the successful Supplier; speed of available response, (including, without limitation, capacity to meet required deadlines and, where relevant, geographical location); quality (including expertise, and proposed methods of undertaking the work); states the charges payable for the Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and incorporates the Call-Off Terms applicable to the Services; provide unsuccessful Framework suppliers with feedback in relation to the reasons why their tenders were unsuccessful.

The Provider's Obligations The Provider will in writing, by the time and date specified by the Contracting Body in accordance with Clause 31.1.3(b), provide unsuccessful Framework suppliers the Contracting Body with feedback either:- a statement to the effect that it does not wish to tender in relation to the reasons why their relevant Requirements; or the Statement of Work and full details of its tender made in respect of the relevant Statement of Requirements. In the event that the Provider submits a Statement of Work, it should include, as a minimum:- an email response subject line to comprise unique reference number and Provider name, so as to clearly identify the Provider; a brief summary, in the email, stating whether or not the Provider is bidding for the Statement of Requirements; a proposal covering the Requirements. confirmation of discounts applicable to the work, as referenced in Schedule 3 The Provider shall ensure that any prices submitted in relation to a further competition held pursuant to this paragraph 3 shall be based on the Charges and take into account any discount to which the Contracting Body may be entitled as set out in Schedule 3. The Provider agrees that all tenders were unsuccessfulsubmitted by the Provider in relation to a further competition held pursuant to this paragraph 3 shall remain open for acceptance for thirty (30) days (or such other period specified in the invitation to tender issued by the relevant Contracting Body in accordance with the Ordering Procedure).

Any Contracting Body ordering the Services awarding a Call Off Agreement under this Framework Agreement through a further competition mayFurther Competition Procedure shall: adopt criteria set out in paragraph 2 of Schedule 6 (Award Criteria) when developing its develop a Statement of Requirements setting out its requirements for the Goods and/or Services and identify the Framework Suppliers capable of supplying the Goods and/or Services; amend or refine the Call-Template Call Off Form and Template Call Off Terms to reflect its Goods and/or Services RequirementsRequirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; or invite tenders by conducting a further competition Further Competition Procedure for its Goods and/or Services Requirements in accordance with the Regulations and Guidance and in particular: if an Electronic Reverse Auction (as defined in paragraph 469 below) is to be held the Contracting Body shall notify the relevant suppliers Framework Suppliers identified in accordance with paragraph 68.1.1 and shall conduct the further competition Further Competition Procedure in accordance with the procedures set out in paragraph 8. If an Electronic Reverse Auction is not used, the Contracting Body shall: Invite the Suppliers to develop a proposed statement of work setting out their respective proposals in respect of such Contracting Body’s Statement of Requirements (a ”Statement of Work”) and invite the Suppliers to submit a tender in writing for each specific contract to be awarded by giving written notice by email to the relevant Supplier Representative of each Framework supplier; Set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and Keep each tender confidential until the time limit agreed by the Parties has expired69.3; apply the criteria set out in paragraph 2 of Schedule 6 (Further Competition Award Criteria) Criteria to the Framework Suppliers’ ' compliant tenders submitted through the further competition Further Competition Procedure as the basis of its decision to award a Call-Call Off Agreement for its Goods and/or Services Requirements; on the basis set out above, award its Services Requirements by placing an Order with Call Off Agreement to the successful Framework Supplier in accordance with paragraph 6 which72 which Call Off Agreement shall: states state the Goods and/or Services Requirements; states state the statement of work tender submitted by the successful Framework Supplier; speed of available response, (including, without limitation, capacity to meet required deadlines and, where relevant, geographical location); quality (including expertise, and proposed methods of undertaking the work); states state the charges payable for the Goods and/or Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and incorporates incorporate the Call-Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 68.1.2 above) applicable to the Goods and/or Services; , provide unsuccessful Framework suppliers Suppliers with written feedback in relation to the reasons why their tenders were unsuccessful.

Contracting Body's Obligations.
