Common use of Continuity of Service and Performance Clause in Contracts

Continuity of Service and Performance. Except as provided in Section 4.4, Section 8.1(c) or Section 8.2 or otherwise agreed in writing, the Parties will continue to provide Services and honor all other commitments under this Agreement, the Separation and Distribution Agreement and each Ancillary Agreement during the course of dispute resolution pursuant to the provisions of this Article X with respect to all matters not subject to such dispute resolution.

Except as provided in Section 4.4, Section 8.1(c) or Section 8.2 or Unless otherwise agreed herein or in writing, the Parties parties will continue to provide Services and honor all other commitments under this Agreement, the Separation and Distribution Agreement and each Ancillary Agreement (as defined in the Distribution Agreement) during the course of dispute resolution pursuant to the provisions of this Article X Section 9 with respect to all matters not subject to such dispute resolutiondispute, controversy or claim.
