Common use of Continuing Contract Performance Clause in Contracts

Continuing Contract Performance. Pending final resolution of a Claim, unless otherwise agreed in writing, Contractor shall proceed diligently with performance of the Contract and Owner shall continue to make payments in accordance with the Contract Documents, subject to Owner's right to withhold payments for sums that it does not agree are due the Contractor. The resolution of any Claim under this Paragraph 4.3.4 shall be reflected by a Change Order executed by Owner, Architect and Contractor.
