Construction Staging Area. Coordinate use of the Site with Owner prior to utilization of the area. Providing Site security, barriers, and other temporary protection is the responsibility of the Contractor. Limit all construction activities within the Work limits shown on the drawings. All areas disturbed in any way or during construction and not covered by roads, parking, or structures shall be rehabilitated to their pre-construction condition.
Construction Staging Area. To the extent any Site is available and not necessary for commencement of a particular Phase or for any staging or other use arising out of the Successor Agency’s obligations hereunder (such as the realignment of Julian Street described in Section 313 below), the Successor Agency shall permit Developer to use appropriate Sites as construction staging areas for construction of the Phases commenced by Developer, at no charge to Developer. The Developer shall indemnify and hold the Successor Agency harmless against any claims resulting from Developer’s use of any Site as a construction staging area except to the extent such claim arose or resulted from the Successor Agency’s own negligence or willful misconduct or that of its respective officers, employees, contractors, agents, successors or assigns. If requested by Developer, the Successor Agency shall use good faith efforts to assist Developer in obtaining other construction staging areas for use by Developer, at its sole cost, during construction of the Project. In no event shall the Successor Agency incur any costs in connection with such assistance and in no event shall the Successor Agency be required to provide a construction staging area for Developer if Developer is unable to find a suitable location.
Construction Staging Area. Rent During the initial construction of the Project, Project Company shall pay “Construction Staging Area Rent” to Owner equal to Five Hundred Dollars ($500.00) per year for each acre that Project Company uses for temporary storage, lay down, staging and batch-plant areas (collectively, the “Construction Staging Areas”); provided, however, that Project Company shall not be required to pay Temporary Storage Rent for any Construction Staging Area (i) located within the Substation Site or (ii) used by Project Company for less than thirty (30) consecutive days. The Construction Staging Area Rent shall be payable within sixty (60) days after commencement of construction of the Construction Staging Areas, as determined when earth-moving equipment breaks ground on the Construction Staging Areas. Any Construction Staging Area Rent for less than a full twelve-month period shall be prorated based on the actual number of days that Project company used the Construction Staging Area in the applicable period. EXHIBIT E SITE RULES Project Company will use commercially reasonable efforts to follow and to cause its personnel to follow the following rules while on the Premises. Owner may bar further access to the Premises by any individual who commits repeated, material violations of these rules after such individual has received at least three written warnings of a particular material violation from Owner describing, and including reasonable evidence documenting, such material violation. In addition, any individual violating rules (d)(i), (iv), or (vi) at least three times after receipt of a third written warning with documented evidence of such violation, will be immediately expelled from the Premises and will be banned from the Premises thereafter. The rules are as follows:
Construction Staging Area. City will provide a parcel of real property south of the Property and as depicted in Exhibit E-2 and legally described in Exhibit E-1 for Developer’s use as a construction staging area. The parties shall execute a commercially reasonable license agreement evidencing Developer’s right to use such area generally in the form of the Temporary Inspection and Construction Easement attached hereto as Exhibit B.

Construction Staging Area. The City agrees to provide use of the City- owned parking lot commonly known as Lot 6 on Highland Avenue to be used as a staging area for the project and related project management modular facilities. The schedule for use of this area will be mutually developed by the City and County.
Construction Staging Area. Seller shall have arranged prior to the end of the Feasibility Period for a temporary easement ("Construction Staging Easement") in favor of Buyer effective as of the Closing to permit Buyer to use Parcels 1 and 6 of Tract 7953 in the City for construction staging purposes in connection with Buyer's contemplated construction of the Project. The Construction Staging easement shall be coordinated with and subject to any temporary parking requirements that need to be provided on such parcels pursuant to Section 5.3.1.2. and shall be of a duration limited to Buyer's contemplated construction period.
Construction Staging Area. Rent During the initial construction of the Project, Project Company shall pay “Construction Staging Area Rent” to Owner equal to Five Hundred Dollars ($500.00) per year, prorated to forty-two ($42.00) per month, for each acre that Project Company uses for temporary storage, lay down, staging and batch-plant areas (collectively, the “Construction Staging Areas”); provided, however, that Project Company shall not be required to pay Temporary Storage Rent form any Construction Staging Area (i) located within the Substation Site or (ii) used by Project Company for less than thirty (30) consecutive days. Construction Staging Area Rent shall convert automatically to Operating Term no more than 90 days after commencement of construction, or when Project Company notifies Owner, whichever happens first. The Construction Staging Area Rent shall be payable within sixty (60) days after commencement of construction of the Construction Staging Areas, as determined when earth-moving equipment breaks ground on the Construction Staging Areas. Any Construction Staging Area Rent for less than a full twelve-month period shall be prorated based on the actual number of days that Project company used the Construction Staging Area in the applicable period.
