Consistency with Federal Law. If this Agreement applies to Blue Shield 65 Plus, Group shall comply and Group shall require that its Group Providers comply with the statutes and regulations and CMS instructions which govern Blue Shield’s Agreement with CMS. Moreover, Group and Group Providers shall comply with the additional obligations set forth in Exhibit H-l hereto. Group also agrees that, to the extent ERISA statutes and regulations apply to the claims payment and Member complaint functions performed by Group, Group and Group Providers shall comply with all such requirements.
