Connection Point. 3.1 KWSC hereby permits and authorizes the RDEK System to be connected to the KWSC System at the Connection Point under the terms and conditions contained in this Agreement. 3.2 Subject to the terms and conditions of this Agreement, KWSC will accept from the RDEK, at the Connection Point, sewage generated solely within the SA, of the following amounts of domestic sewage: a) Average Flow: 170 cubic meters per day; b) Total Annual Volume: 62,050 cubic meters per year. c) In reference to sections 3.2 a) and b), should the RDEK sewage volumes as confirmed at the Meter be less than the volume shown in Sections 3.2 a), then KWSC shall be obligated to have the capacity to accept 120% of the Average Flow as confirmed at the Meter for the period April 1st to September 30th from the previous year plus allowance for any new connection applications received by the RDEK from the time of the last Meter reading, or 100% of those volumes as in Sections 3.2 a) and b), whichever is less. d) The allowance for each new connection application shall be based on the Average Flow of the immediately preceding year divided by the total number of existing units within the SA. 3.3 The domestic sewage accepted at the Connection Point and generated within the SA must meet the standards and requirements adopted and amended by KWSC from time to time, and any applicable federal, provincial and local government laws, regulations, Codes and standards, and must be normal strength sewage received from residential use and occupancy and having a BOD not exceeding 200 milligrams per litre and TSS not exceeding 200 milligrams per litre. 3.4 The Parties acknowledge and agree that there may be reasonable concerns which may arise from time to time regarding the flows/volumes of sewage and sewage characteristics received at the Connection Point. The Parties agree to use a collaborative approach to addressing any reasonable bone fide concerns raised in this regard. 3.5 The Parties acknowledge and agree that there may be reasonable concerns which may arise from time to time as to whether the sewage disposal capacity is adequate or sufficient to meet the sewage service requirements of the SA. The Parties agree to use a collaborative approach to addressing any reasonable bone fide concerns raised in this regard. Nevertheless, the Parties acknowledge that the sewage disposal regime outlined in Section 3.2 anticipates providing sewage disposal to: a) 285 single family SA Residences* b) 151 two-family or multiple family SA Residences Furthermore, the sewage disposal regime outlined in Section 3.2 takes into account infiltration and inflow conditions. *Includes pool and beach house 3.6 In the absence of a Meter at the Connection Point, the Parties agree that an alternative means of satisfactorily determining the sewage flows by calculation or otherwise will be acceptable by mutual agreement. This could include sewage flows being a percentage of water demands, or as calculated by pump run times at the sewage pumping station, etc.
