Condition upon Termination. Tenant shall repairNotwithstanding the foregoing, at Tenant's expense, any damage to the Property caused by the removal of any such machinery or equipment. In in no event, however, event shall Tenant remove any of the following materials or equipment (which shall be deemed Landlord's ’s property) without Landlord's prior written consentreplacing the same with materials or equipment of equal or better quality: any power wiring or power panels; inset or recessed lighting or lighting fixtures; wall coverings; drapes, blinds or other window coverings; carpets or other floor coverings; heaters, air conditioners or any and other heating or air conditioning equipment that are not portable; plumbing or sanitary equipment; or fencing or security gates; . Landlord may require Tenant to remove Alterations installed by Tenant during the Term if, and only if, Landlord’s consent was required for such Alterations during the Term and Landlord informed Tenant in writing at the time of such consent that Landlord would require removal of same at the end of the Term. All Alterations, if any, which Landlord is permitted to require Tenant to remove hereunder but which Landlord does not require Tenant to remove (and which Tenant does not otherwise elect to remove) shall become Landlord’s property and shall be surrendered to Landlord upon the expiration or other similar building operating equipment and decorations except earlier termination of the Lease. Tenant shall repair, at Tenant’s expense, any damage to the extent installed Premises caused by Tenant’s removal of Alterations and FF&E; provided, however, that Tenant shall not be required to repaint the Premises or patch immaterial wall or floor penetrations.

In no event, however, shall Tenant remove any of the following materials or equipment (which shall be deemed Landlord's ’s property) without Landlord's ’s prior written consent: any power wiring or power panelspanels except electrical drops; lighting or lighting fixturesfixtures except task lighting; wall coverings; drapes, blinds or other window coverings; carpets or other floor coverings; heaters, air conditioners or any other heating or air conditioning equipment; fencing or security gatesgates except inventory fencing; or other similar building operating equipment and decorations except decorations. Landlord shall have the right to dispose of any personal property left on the Premises at the expiration or earlier termination of this Lease without any obligation to account to Tenant or any other party therefor. In the event that Tenant fails to put the Premises in the condition required by the terms of this Section 6.06 at such time as this Lease expires or terminates, or if Tenant leaves any personal property on the Premises, Landlord shall have the right, but not the obligation, to perform Tenant’s obligations under this Section 6.06 and all reasonable costs and expenses incurred by Landlord in connection therewith, including without limitation removal of alterations, additions or improvements, repair of damage to the extent installed Premises, and disposal costs of any personal property left on the Premises, shall be paid to Landlord by TenantTenant upon demand and such obligation shall survive the expiration or earlier termination of this Lease. Condition upon Termination. If Tenant fails, by the expiration of this Lease or within thirty (30) days following any earlier termination of the Lease Term, to restore the Property to the condition required under this Section 6.06, then Tenant shall pay Landlord on demand an amount equal to the cost of such restoration work, plus an administration fee equal to fifteen percent (15%) of such amount. Notwithstanding any language to the contrary in this Section 6.06, Landlord shall notify Tenant in writing at the time (a) Tenant seeks Landlord’s consent to any Tenant’s Alterations, or (b) Tenant provides written notice to Landlord of any Tenant’s Alterations not requiring Landlord’s consent, that Landlord state (at the time it grants its consent, if applicable) whether or not removal will be required at the expiration or earlier termination of the Lease Term. Any such written request of Tenant shall specifically cite this Lease provision and Landlord’s obligation to make such a statement.
