Common use of Complying Proposal Clause in Contracts

Complying Proposal. (a) Where the Employer or nursing staff have a proposal that redistributes or increases the current nursing hours applying from the ratios or the CWMA, and the proposal contains at least the current nursing hours over a four week roster period and does not increase the number of ‘short shifts’ beyond the number referred to in clause 0 or 0, the Employer shall: (i) Provide, in writing, the proposal to amend the CWMA to all affected nursing staff and provide the following information: (A) the clinical nursing assessment of patient needs; (B) the demands of the environment such as patient layout; (C) statutory obligations including OHS legislation; (D) the requirements of nurse regulatory legislation and professional standards; (E) workloads; and
