The Developer certifies that as of the date of this Agreement, the Developer is not listed on the Final Divestment List created by the North Carolina State Treasurer pursuant to N.C.G.S. Section 147-N.C. Gen. Stat. § 147-86.58. Developer understands that it is not entitled to any payments whatsoever under this Agreement if this certification is false. The individual signing this Agreement certifies that he or she is authorized by the Developer to make the foregoing statement.
