Compliance with Insurance Standards. (a) Tenant shall not violate, or permit the violation of, any condition imposed by any insurance policy that would customarily cover a First Class Office Building and shall not do, or permit anything to be done, or keep or permit anything to be kept in the Premises, which would subject Landlord, any Superior Lessor or any Superior Mortgagee to any liability or responsibility for personal injury or death or property damage, or which would increase any insurance rate in respect of the Project over the rate which would otherwise then be in effect or which would result in insurance companies of good standing refusing to insure the Project in amounts reasonably satisfactory to Landlord, or which would result in the cancellation of, or the assertion of any defense by the insurer in whole or in part to claims under, any policy of insurance in respect of the Project. Landlord hereby agrees that the uses permitted under Section 2.05 do not violate its insurance policies. (b) If, by reason of any failure of Tenant to comply with this Lease, the premiums on Landlord's insurance on the Project shall be higher than they otherwise would be, Tenant shall reimburse Landlord, within twenty (20) days of demand, for that part of such premiums attributable to such failure on the part of Tenant. A schedule or "make up" of rates for the Project or the Premises, as the case may be, issued by the New York Fire Insurance Rating Organization or other similar body making rates for insurance for the Project or the Premises, as the case may be, shall be conclusive evidence of the facts therein stated and of the several items and charges in the insurance rate then applicable to the Project or the Premises, as the case may be.

(a) Tenant shall not violate, or knowingly permit the violation of, any condition imposed by any insurance policy that would customarily cover a First Class Office Building then issued in respect of the Project and shall not do, or knowingly permit anything to be done, or keep or knowingly permit anything to be kept in the Premises, which would subject Landlord, any Superior Lessor or any Superior Mortgagee to any liability or responsibility for personal injury or death or property damage, or which would increase any insurance rate in respect of the Project over the rate which would otherwise then be in effect or which would result in insurance companies of good standing refusing to insure the Project in the amounts reasonably satisfactory to Landlordrequired by any Superior Lessor or Superior Lessee, or which would directly and result in the cancellation of, or the assertion of any defense by the insurer in whole or in part to claims under, any policy of insurance in respect of the Project. Landlord hereby agrees Project ; it being understood that the uses mere use of the Premises as expressly permitted under this Lease, and subject to compliance with Section 2.05 do 4.05 of this Lease, will not violate its insurance policiesresult in a violation of the provisions hereof.
(b) If, directly, solely, and demonstrably by reason of any failure of Tenant to comply with this Lease, the premiums on Landlord's ’s insurance on the Project shall be higher than they otherwise would be, Tenant shall reimburse Landlord, within twenty ten (2010) days of Business Days following written demand, for that part of such premiums directly and solely attributable to such failure on the part of Tenant. A schedule or "“make up" ” of rates for the Project or the Premises, as the case may be, issued by the New York Fire Property Insurance Rating Organization Underwriting Association or other similar body any successor entity making rates for insurance for the Project or the Premises, as the case may be, shall be conclusive evidence of the facts therein stated and of the several items and charges in the insurance rate then applicable to the Project or the Premises, as the case may be.
