Compliance by Other Lessees Sample Clauses

Compliance by Other Lessees. Lessor shall not be liable to Lessee for the failure of any other occupant or tenant to conduct itself in accordance with the provisions of this Article 6, and Lessee shall not be released or excused from the performance of any of its obligations under this Lease in the event of any such failure; provided, however, that Lessor shall use commercially reasonable efforts (but not including the institution of legal proceedings) to cause such other tenants and occupants of the Property to comply with the provisions of this Article 6, to the extent such non-compliance materially and adversely interferes with Lessee’s access to the Premises or use of the Premises for the purposes permitted under this Lease.

Compliance by Other Lessees. Lessor shall use commercially reasonable efforts (including, without limitation, unlawful detainer proceedings where commercially reasonable efforts would require such) at least comparable to those that would be used by other landlords of Comparable Buildings, to secure the compliance by other tenants of the Building with all use restrictions affecting the Building; provided, however, that Lessor shall not, so long as Lessor is using commercially reasonable efforts, be liable to Lessee for any other occupant’s or tenant’s failure to conduct itself in accordance with the provisions of this Article 6, and Lessee shall not be released or excused from the performance of any of its obligations under this Lease in the event of any such failure.
