Communications by fax. Subject to clause 9.6, a communication is deemed given if sent by fax, when the sender’s fax machine produces a report that the fax was sent in full to the addressee. That report is conclusive evidence that the addressee received the fax in full at the time indicated on that report.
Communications by fax. The Trustee is authorized to perform acts and proceedings instructed by the Technical Committee by communications transmitted by fax, as long as the authenticity of said communications is verified. Notwithstanding the foregoing, the parties recognize that the Trustee maintains certain internal policies regarding the use of manual processes for the receipt and processing of instructions transmitted by fax or other manual methods. Therefore, the person appointed by the Technical Committee for such purposes shall sign the document containing said policies together with the Trustee at the signing of this Agreement.
