Common use of Commercial Tort Claims Clause in Contracts

Commercial Tort Claims. If any Grantor shall at any time hold or acquire a Commercial Tort Claim, such Grantor shall promptly notify the Agent in a writing signed by such Grantor of the particulars thereof and grant to the Agent in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Agent.

Commercial Tort Claims. If any Grantor shall at any time hold or acquire a Commercial Tort Claim, such Grantor shall promptly notify the Administrative Agent thereof in a writing signed by such Grantor Grantor, including a summary description of the particulars thereof such claim, and grant Schedule III hereto shall be deemed to the Agent be supplemented to include such description of such Commercial Tort Claim as set forth in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Agentwriting.

If any such Grantor shall at any time hold or acquire a any Commercial Tort Claim, such Grantor shall promptly notify the Agent thereof in writing, therein providing a writing signed by reasonable description and summary thereof, and upon delivery thereof to Agent, such Grantor of the particulars thereof and shall be deemed to thereby grant to the Agent in (and such writing Grantor hereby grants to Agent) a security interest therein in such Commercial Tort Claim and in the all proceeds thereof, all upon the terms and such Grantor shall execute such documentation as Agent shall require in order to document and effectuate such grant of this Agreement, with such writing to be in form and substance satisfactory to the Agenta security interest.

If any Grantor shall shall, now or at any time hereafter, hold or acquire a Commercial Tort Claimcommercial tort claim, such Grantor shall promptly immediately notify the Administrative Agent in a writing signed by such Grantor of the particulars thereof and grant to the Agent Administrative Agent, for the benefit of Secured Parties, in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Amended Security Agreement, with such writing to be in form and substance satisfactory to the Administrative Agent.

If any Grantor shall at any time hold or acquire a Commercial Tort Claim, such Grantor shall promptly notify the Agent in a writing signed by such Grantor of the particulars brief details thereof and grant to the Agent in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Agent.

If any such Grantor shall at any time hold or acquire a Commercial Tort Claimcommercial tort claim that it has asserted against any other Person, such Grantor shall promptly immediately notify the Agent in a writing signed by such Grantor of the particulars brief details thereof and grant to the Agent for the benefit of the Secured Creditors in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance reasonably satisfactory to the Agent.

Commercial Tort Claims. If any Grantor shall shall, now or at any time hereafter, hold or acquire a Commercial Tort Claimcommercial tort claim, such Grantor shall promptly notify the Collateral Agent in a writing signed by such Grantor of the particulars thereof and grant to the Agent Collateral Agent, for the benefit of the Senior Secured Parties, in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Collateral Agent. Such notice shall be deemed to be an amendment to such Grantor’s Perfection Certificate with respect to such commercial tort claim.

Commercial Tort Claims. If any Grantor shall at any time hold or acquire undertake a Commercial Tort ClaimAction, such the Grantor shall promptly notify the Collateral Agent thereof in a writing signed by such Grantor Grantor, including a summary description of the particulars thereof such claim, and grant to the Collateral Agent in such writing a first-priority security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory as necessary to perfect the Agentsecurity interest in such Commercial Tort Action.

Commercial Tort Claims. If any Grantor shall at any time hold or acquire a Commercial Tort Claim, such Grantor shall promptly notify the Administrative Agent thereof in a writing signed by such Grantor Grantor, including a summary description of the particulars thereof such claim, and grant Schedule IV hereto shall be deemed to the Agent be supplemented to include such description of such Commercial Tort Claim as set forth in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Agentwriting.

If any such Grantor shall at any time hold or acquire obtains a Commercial Tort ClaimClaim that is not Excluded Collateral, such Grantor then it shall promptly notify the Agent in a writing signed by such Grantor setting forth a brief description of the particulars thereof such Commercial Tort Claim and grant granting to the Agent in such writing a security interest therein and in the proceeds Proceeds thereof, all upon which writing shall incorporate the terms of this Agreement, with such writing to provisions hereof and shall be in form and substance reasonably satisfactory to the Agent.

If any Grantor shall at any time hold or acquire a Commercial Tort Claimcommercial tort claim, such Grantor shall promptly immediately notify the Collateral Agent in a writing signed by such Grantor of the particulars thereof and grant to the Agent Collateral Agent, for the benefit of the Secured Creditors, in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Collateral Agent.

Commercial Tort Claims. If any Grantor shall at any time hold or acquire any Commercial Tort Claim in excess of the Minimum Actionable Amount (determined for all such Commercial Tort Claims of the Grantors in the aggregate), such Grantor shall, if such Grantor has not previously notified the Agent, notify the Agent thereof and sign and deliver to the Agent by the next Collateral Notification Date an agreement in the form of Annex V hereto granting a security interest under the terms and provisions of this Agreement in and to such Commercial Tort Claim, such Grantor shall promptly notify the Agent in a writing signed by such Grantor of the particulars thereof and grant to the Agent in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the Agent.

Commercial Tort Claims. If any the Grantor shall at any time hold or acquire a Commercial Tort ClaimClaim for which a complaint has been filed in a court of competent jurisdiction, such the Grantor shall promptly immediately notify the Security Agent in a writing signed by such the Grantor of the particulars brief details thereof and grant to the Security Agent in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Security Agreement, with such writing to be in form and substance satisfactory to the Security Agent.

Commercial Tort Claims. If any Grantor shall at any time hold or acquire a Commercial Tort Claim, then such Grantor shall promptly immediately notify the Agent Lender in a writing signed by such Grantor of the particulars brief details thereof and grant to the Agent Lender in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance satisfactory to the AgentLender.

Commercial Tort Claims. If any Grantor shall at any time after the date hereof hold or acquire a Commercial Tort Claim, such Grantor shall shall, promptly following such acquisition, notify the Collateral Agent thereof in a writing signed by such Grantor of and reasonably describing the particulars details thereof and shall grant to the Collateral Agent in such writing a security interest therein (subject to Permitted Liens) and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance reasonably satisfactory to the Collateral Agent.

If any Grantor shall at any time hold or acquire a Commercial Tort ClaimClaim in an amount reasonably estimated to exceed $[__], such the Grantor shall promptly notify the Administrative Agent thereof in a writing signed by such Grantor Grantor, including a summary description of the particulars thereof such claim, and grant to the Administrative Agent in such writing a security interest therein and in the proceeds thereof, all upon the terms of this Agreement, with such writing to be in form and substance reasonably satisfactory to the Administrative Agent.
