Common use of Code Compliance Clause in Contracts

Code Compliance. The Developer shall comply with all codes, ordinances, and rules and regulations of the City. Development of the Property shall also be in conformance with all aspects of the Final Plans and shall be completed prior to issuance of the first certificate of occupancy within the Property. This shall include, but not be limited to, street and parking lot paving and striping, landscaping, trash enclosures, rooftop and wall mounted equipment, building elevations, and all other requirements of the Final Plans and applicable City codes, ordinances, and rules and regulations.

Code Compliance. The Developer shall comply with all applicable codes, ordinances, and rules and regulations of the City. Development of the Property shall also be in conformance with all aspects of the Final Plans and shall be completed prior in compliance with the Phasing Plan (as described below). The provisions of this Section 2 shall apply to issuance of the first certificate of occupancy within the Property. This shall includemail facilities, but not be limited to, street and parking lot paving and striping, landscaping, trash enclosures, rooftop and wall mounted equipment, building elevations, retaining walls and all other requirements of the Final Plans and (as may be applicable for each phase in accordance with applicable City codes, ordinances, and rules and regulations.
