Clawback Right. Notwithstanding any other provision of this Agreement, any performance-based payments or benefits provided under this Agreement shall be subject to recovery or clawback by the Company under any clawback policy adopted by the Company applicable to all executive officers of the Company whether before or after the effective date of this Agreement.
