Claims under Warranties or Tax Deed. In the event that the Purchaser is entitled to an Indemnity Claim or a claim under the Tax Deed or under the Warranties in respect of the same subject matter, the Purchaser may claim under either or all but payments under the Tax Deed shall pro tanto satisfy and discharge any Indemnity Claim or claim which is capable of being under the Warranties in respect of the same subject matter and vice versa.
