CITY’S AUTHORITY. City represents that it is a home rule municipality located in Bexar County, Texas, and has authority to carry out the obligations contemplated by this Agreement.
CITY’S AUTHORITY. The parties signing this Agreement on behalf of the City have been authorized to do so by specific action of the Mayor and City Council adopted in open meeting and of record in its official minutes.
CITY’S AUTHORITY. This agreement shall not restrict the City’s authority to prohibit the non-prescribed use, sale or possession of alcohol and/or other drugs during work hours, or restrict the City’s authority to discipline, suspend, or dismiss an employee for being under the influence of, selling or possessing alcohol and/or other drugs during work hours, except as that authority is restricted under this Agreement.
CITY’S AUTHORITY. City covenants and warrants to Lessee that (i) it has full right, power and authority to execute this Master Lease and each Facilities Lease and has the power to grant all rights hereunder, (ii) its execution and performance of this Master Lease and each Facilities Lease will not violate any laws, ordinances or covenants, or the provisions of any mortgage, lease or other agreement binding on City, and (iii) Lessee shall have the quiet enjoyment of the City Facilities, and Lessee shall not be disturbed as long as Lessee is not in default beyond any applicable grace or cure period.
CITY’S AUTHORITY. The Union recognizes that the City has the authority to suspend, demote, discharge or take other appropriate disciplinary action against employees for just cause. Any non-probationary employee who is subject to discipline may appeal same pursuant to the grievance procedure or to the Civil Service Commission pursuant to Title VI of the 1971 Code of Ordinances of the City, but not both. The filing of any appeal to one forum constitutes a waiver of any right to appeal to the other forum.

Monthly rate for additional 95 gallon roll-carts: $7 per month, per cart at the same address.
CITY’S AUTHORITY. B7.1 Nothing in this Design Build Agreement shall in any way xxxxxx the right, authority and discretion of the City or any Governmental Authority in fulfilling its statutory or regulatory functions under Applicable Law, and Design Builder understands and agrees that nothing in this Design Build Agreement shall preclude the City of Winnipeg from performing, discharging or exercising its duties, responsibilities and powers under Applicable Law. For clarity, nothing in this Design Build Agreement shall compel the City of Winnipeg to take any actions in relation to the Project or the Design Builder, including the issuance of any applicable Permits, Licences and Approvals.
CITY’S AUTHORITY. Although the School Resource Officer will work collaboratively with District’s Superintendent, Principals, and their designees, the School Resource Officer will be supervised by the Chief of Police or designee. The Chief of Police or designee is responsible for determining the School Resource Officer’s work assignment and ensuring compliance with the Police Department’s directives. The City will retain its authority over officer standards of performance, conduct and discipline of officers, performance reviews, and other internal matters related to enforcement services. Upon request of the City, District shall provide the City with a written appraisal of the services rendered by a School Resource Officer at the end of each contract term. District shall immediately notify the City in writing of any performance deficiencies or inappropriate conduct of a School Resource Officer. All disciplinary action shall be under authority of the City.
CITY’S AUTHORITY. City is a municipal corporation created under the laws of the State of California. City has full power and authority to enter into this Agreement and to perform this Agreement. The execution, delivery and performance of this Agreement by City have been duly authorized by all necessary action on the part of City and all required consents and approvals have been duly obtained.
CITY’S AUTHORITY. City at all times shall the authority to refuse entry and/or to remove persons and property from Prospect Park and the Premises for violation of any State or City law, rule or regulation.
