Common use of Circuit Speed Availability Clause in Contracts

Circuit Speed Availability. Verizon cannot guarantee the Access Speed of Local Access circuits. Customer specifically acknowledges and agrees that the Access Speed may not always be fully available because the burst rates may be reduced by modem rate adaptation, protocol overhead in the underlying network, properties of transmitted IP traffic stream, Customer Site distance from the wire center, access network technology and configuration, interference at the Customer Site, and by the method of data transmission.
