Common use of Choice of Provider Clause in Contracts

Choice of Provider. The Provider will assure that the participant is receiving services under this Agreement by the provider of his or her choice, and that referrals to other providers of service will not interfere with a participant’s freedom of choice in seeking medical care from any institution, agency, pharmacy or person who is qualified to perform a required service. If a participant is under 18 years of age or mentally incapable of choice of provider, the Provider will assure that the participant’s legally authorized representative makes such choices for the participant, unless the participant is authorized to make this choice under Federal or State law.
