Changed to. Construction Manager represents to the District that it has the necessary license for a Construction Manager as provided for in Government Code Section 4525, et seq.; that it has expertise and experience in construction supervision; bid evaluation; project scheduling; cost benefit analysis; claims review and negotiation; and general management and administration of construction projects. This Agreement shall also incorporate herein by reference, the Request for Qualifications and Proposals (RFQP) for Construction Management Services; Procurement No.: CC03-3640.01 and all attachments and exhibits to the RFQP issued by the District, but only as it relates to the Construction Manager’s scope of work, services and responsibilities. Any conflicts, inconsistencies or ambiguities between the RFQP and this Agreement shall be interpreted in favor of this Agreement and governed by this Agreement.

  • Change The School, as any other, is likely to undergo a number of changes during the period of this agreement. For example, there may be changes in the staff, and in the premises, facilities and their use, in the curriculum and the size and composition of classes, and in the School rules and procedures, the disciplinary framework, and the length of School Terms. In addition, there may be the need to undertake a corporate reorganisation exercise and / or a merger or change of ownership may be necessary. For these reasons, the benefit and burden of this agreement may be freely assigned to another party at the discretion of the School.

  • Structure a) The committee will meet as necessary at times determined by the Association and TEBA. b) The Association and TEBA shall each bear the cost of their participation in this committee. c) The Association and TEBA will each appoint three (3) representatives to the committee. d) The committee will be chaired jointly.

  • Individual Characteristics Each Receivable has the following individual characteristics as of the Cut-Off Date: (i) each Receivable is secured by a new or used automobile, minivan or sport utility vehicle; (ii) each Receivable has a Contract Rate of no less than 0.00%; (iii) each Receivable had an original term to maturity of not more than 72 months and not less than 12 months and each Receivable has a remaining term to maturity, as of the Cut-Off Date, of 3 months or more; (iv) each Receivable has an Outstanding Principal Balance as of the Cut-Off Date of greater than or equal to $1,000.00; (v) no Receivable has a scheduled maturity date later than July 31, 2027; Schedule I-1 Schedule I to the Purchase Agreement (vi) no Receivable was more than 30 days past due as of the Cut-Off Date; (vii) as of the Cut-off Date, no Receivable was noted in the records of VCI or the Servicer as being the subject of any pending bankruptcy or insolvency proceeding; (viii) no Receivable is subject to a force-placed Insurance Policy on the related Financed Vehicle; and (ix) each Receivable is a Simple Interest Receivable.

  • Recognition of Previous Experience (a) The Employer will recognize recent related RN experience on the basis of one (1) annual increment for each one (1) year of service up to the maximum of the grid. Part-time service shall be recognized on the basis of fifteen hundred (1500) hours paid in previous employment equals one (1) year of service. It shall be the responsibility of a newly hired employee to make a claim of recent and related experience within the probationary period in order to be considered for a salary increment. If she/he fails to make a claim in the specified time period or fails to provide reasonable proof of recent related experience, she/he shall not be entitled to recognition.

  • Characteristics The Contracts have the following characteristics: (i) all the Contracts are secured by Motorcycles; (ii) no Contract has a remaining maturity of more than 84 months; and (iii) the final scheduled payment on the Contract with the latest maturity is due no later than September 6, 2031. Approximately 74.40% of the Pool Balance as of the Cutoff Date is attributable to loans for purchases of new Motorcycles and approximately 25.60% is attributable to loans for purchases of used Motorcycles. No Contract was originated after the Cutoff Date. No Contract has a Contract Rate less than 0.010%.
