Common use of Change of Operators Clause in Contracts

Change of Operators. The Participating Companies may change the Operator, and the Operator may resign from its role as Operator, subject to the prior written consent of the CNH, in the understanding that the new operator shall at least comply with the prequalification criteria established for the Operator in the bidding process for this Contract, provided that the Change of Operator occurs during the first five (5) years following the Effective Date, or if applicable, that there is evidence that the new operator has been prequalified by CNH in a bidding process for areas with characteristics similar to the Contract Area of this Contract in the five (5) years prior to the Change of Operator. The change of Operator shall be approved in accordance with Article 24 of this Agreement and in terms with the Applicable Laws. In the event CNH does not issue a decision during the period set forth in this Contract, it will be deemed to have made in favorable decision.

The Participating Companies may change the Operator, and the Operator may resign from its role as Operator, subject to the prior written consent of the CNH, in the understanding provided that the any new operator Operator shall comply at least comply a minimum with the prequalification criteria established for the Operator in the bidding process for this Contract, provided that the Change of Operator occurs takes place during the first five (5) years following the Effective Date, ; or if applicable, that there is evidence that the new operator has been prequalified by CNH in a bidding budding process for areas with characteristics similar to the Contract Area of this Contract in the five (5) years prior to the Change of Operator. The change of Operator shall be approved in accordance with Article 24 of this Agreement and in terms with the Applicable LawsClause 2.6. In the event case CNH does not issue a decision approve the change of Operator during the period set forth in this Contractcorresponding period, it will be deemed to have made in a favorable decision.
