Common use of Certified Clause in Contracts

Certified. It is intended that as training, upgrading and apprenticeship program develops and becomes implemented by the Joint Apprenticeship & Training Fund Committee that the possession of recognized Certificates of Qualification or Inter-Provincial Red Seal designation will become the norm, in order to receive the rate of pay as outlined in Craft Schedule “A”. To this end, the following Wage & Holiday Pay designation will apply to those employees who are not in possession of a recognized certificate or who are not registered apprentices. - 10% less than full rate Exceptions to the foregoing schedule may be made upon approval of the Trustees of the Training Fund in cases where an individual was prevented by circumstances beyond their own control, the opportunity to obtain necessary certification (present members only). All new members of the Local will receive the applicable rate in accordance with this Article until such time as they are in possession of the necessary certification. Employees in possession of the necessary certification will receive and enjoy preference of employment over a non-certified employee including bumping privileges. Any employee affected by this clause may appeal to the Trustees of the Training Fund for reconsideration. Probationary Worker: Employers may, at the discretion of the union, hire probationary workers.
