Certification Without Prejudice. In the event the Agreement is terminated as provided herein, the Parties agree that the certification of the Action as a class proceeding was for the sole purpose of effecting the Settlement and shall be without prejudice to any position that any of the Parties may later take on any issue in the Action.

Certification Without Prejudice. The Parties agree that the certification of the Action as a class proceeding in accordance with section 9.1 hereof is for the sole purpose of effecting the Settlement. In the event the Agreement is terminated as provided herein, the Parties agree that the certification of the Action order will be set aside as a class proceeding was for the sole purpose of effecting the Settlement set out herein and shall be without prejudice to any position that any of the Parties may later take on any issue in the ActionAction including in a subsequent certification motion.
