Common use of Certification of Non-Retention Clause in Contracts

Certification of Non-Retention. Illuminate certifies that, in accordance with this Agreement, Pupil Records will not be retained or available to Illuminate upon completion of the terms of this Agreement. This certification may be enforced through any lawful means, including but not limited to civil action.

Certification of Non-Retention. Illuminate certifies that, in accordance with this Agreement, Pupil Records will not be retained or available to Illuminate upon completion of the terms of this Agreement; however, this does not include backups or archives used in the ordinary course of Illuminate’s business that are permanently destroyed on a regular cadence. This certification may be enforced through any lawful means, including but not limited to civil action.
