CATERING SERVICE as defined in Recital B.
CATERING SERVICE. 5.1 The Contractor will maintain a catering service for the customers of The Orchard Theatre and for more general public use, so long as this is commercially viable.
1. The Authority shall pay to the Contractor the following sums which shall be annually adjusted in accordance with the CPI on 1 November each year, initially based on November 2008 (i.e. 109.9): Year 1 £374,115 Year 2 £357,635 Year 3 £346,060 Year 4 £348,664 Years 5 - 10 £352,389p.a. Years 11 – 20 £387,389 p.a.
2. Payment, for each year of this Agreement, shall be made by the Authority in twelve equal instalments, following receipt of invoices.
3. In the event that the Improvement Works detailed in the Twelfth Schedule cost less than £350,000, the annual sums referred to in paragraph 1 above shall be adjusted upwards by one tenth of the difference between £350,000 and the cost of the Improvement Works for each of the first ten years of this Agreement.
4. The Contractor shall pay to the Authority 10% of its net profit before tax achieved in any year of this Agreement, where this is a positive figure, payable in a single payment within six months of the Contractor’s financial year end. The Contractor will supply a copy of audited accounts to the Council within 6 months of its financial year end. This Monitoring Schedule sets out how the Authority will monitor the provision of the Services specified in the Specification Schedule.

CATERING SERVICE. Overview
2.1.1. Wholesome, nutritious and tasty food for pupils and teachers
CATERING SERVICE. A. Catering services using the kitchen will be allowed to use kitchen utensils. Items not allowed to be used by the catering service will be posted.
B. Catering services will have to remove their equipment upon close of the function.
C. Catering services will not set up as to block exits or entrance ways.
CATERING SERVICE. A. The catering shall be related to the Indian Lake Local Schools or held at the Indian Lake Local Schools.
B. Minimum participation shall be established by the Board, in the range of 100 participants per event.
C. Bidding for event services shall be offered to individuals in the following priority:
1. food services personnel in the bargaining unit with training and experience necessary to perform the services on the basis of seniority;
2. food services personnel in the bargaining unit who can perform the services without incurring overtime wages on the basis of seniority;
3. any other food services personnel, including substitutes, on the basis of seniority;
4. other bargaining unit members who can perform the services without incurring overtime wages, on the basis of seniority;
5. any other bargaining unit members on the basis of seniority. Employees outside of the food service classification (▇▇▇▇/cashier/dishwasher/ head ▇▇▇▇) shall be paid at step 0 on the food service category of ▇▇▇▇/cashier/dishwasher for hours worked.
CATERING SERVICE. DEVELOPER acknowledges and agrees that: (1) DEVELOPER is not granted, and COMPANY has no obligation to offer to DEVELOPER, any rights within or outside the Development Area or the Sub-Areas to offer Catering Service from any of the DEVELOPER Stores or otherwise pursuant to this Agreement; and (2) the right to provide Catering Service is specifically reserved to COMPANY or its designees. If COMPANY, at any time and in its sole discretion, determines to offer Catering Service in a designated Catering Area in which a DEVELOPER Store is located, COMPANY will offer DEVELOPER the right to offer Catering Service by delivering to DEVELOPER a form of Catering Rider to this Agreement (or to the applicable Franchise Agreement or License Agreement). DEVELOPER will have fifteen (15) days after its receipt thereof to execute and deliver to COMPANY such executed Catering Rider. A Catering Facility will not be counted as a separate DEVELOPER Store for purposes of the Sub-Area Quotas or the Total Development Quota set forth in the Development Schedule. If DEVELOPER fails to execute and deliver to COMPANY such executed Catering Rider within such fifteen (15) day period or commence Catering Service within the specified period, then DEVELOPER shall have no right to provide Catering Service within the designated Catering Area thereafter. If COMPANY determines in its sole discretion that all franchise owners and license owners of Stores in the trade area where a DEVELOPER Store is located, as such trade area is determined by COMPANY in its sole discretion and which in no event shall exceed the Marketing Area (as defined in the License Agreement), shall offer Catering Service, COMPANY will notify DEVELOPER and will deliver to DEVELOPER a Catering Rider to this Agreement (or to the applicable Franchise Agreement or License Agreement) which DEVELOPER shall execute and return to COMPANY within fifteen (15) days after its receipt. COMPANY reserves the right under the Catering Rider, at any time and in its sole discretion, with or without cause and regardless of the investment made by DEVELOPER in establishing and conducting Catering Service or the length of time DEVELOPER has offered Catering Service: (1) to reduce, modify or expand the Catering Area, effective upon COMPANY's written notice to DEVELOPER, provided, however, that if a reduction or modification of the Catering Area amounts to a termination of substantially all of DEVELOPER's rights to provide such services (except in t...
CATERING SERVICE. DEVELOPER agrees that, within ( ) days after the execution date of this Rider and thereafter during the remainder of the term of the Agreement, subject to earlier termination by COMPANY as provided below in this Rider, DEVELOPER will offer and provide Catering Service (defined below) from the Stores or, if required by COMPANY in its sole discretion, from a catering facility ("CATERING FACILITY") to customers located within the geographic area described in Schedule A attached hereto ("CATERING AREA"). As used herein, "Catering Service" shall mean the delivery of Products prepared at the Stores or a Catering Facility to customers in the Catering Area, where (a) such Products are intended to serve fifteen (15) or more persons, or (b) in addition to the delivery of Products, DEVELOPER provides ancillary services to a customer at a location within the Catering Area, including, by way of example and without limitation, setting up for serving or other distribution of Products. The Stores or the Catering Facility, whichever is used for the conduct of Catering Service by DEVELOPER, shall be referred to herein as the "Catering Location" and shall be identified in Schedule A attached hereto immediately after COMPANY approves such Catering Facility in writing pursuant to the requirements of Paragraph 2 below. DEVELOPER acknowledges and agrees that Catering Service shall not include Delivery Service, as defined in the Agreement. DEVELOPER, at its sole expense, shall take such actions (including, without limitation, constructing such improvements and acquiring fixtures, equipment, vehicles, and other materials and supplies) and obtain such permits as are required to commence Catering Service from the Catering Location within the (___) day period specified above.

(E) For the avoidance of doubt, the Hotel has no obligation to accommodate or take into consideration any request to change the details relating to the Catering Service including food, menu, beverages and dietary requirements which are received after the date specified in Error! (F) The Customer should be aware that there may be instances where certain food or beverages cannot be sourced by the Hotel from its usual suppliers for provision as part of the Catering Service. The Customer agrees to any changes that the Hotel may make to the food or beverages provided as part of the Catering Service due to certain material or product not being made available to the Hotel by its usual suppliers in the necessary quantity and/or sufficiently in time for the Hotel to provide the Catering Service.
CATERING SERVICE. (A) The Hotel provides a catering service in the Function Room(s) specified in the contract on the day and during the time specified in the contract.
(B) The food and beverages that the Hotel arranges to be provided in the relevant Function Room(s) are as specified in the contract.
