CAREFULLY BEFORE SIGNING. For good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I grant irrevocable permission to Cuyahoga Community College District (the “College”) and its trustees, officers, students, vendors, consultants, agents and employees (collectively, the “affiliates”) to use my name, photograph, video, likeness, voice, statements associated with event(s) in any and all manner and media throughout the world, in perpetuity. I waive any right that I may have to inspect or approve any such use. I agree that the materials may be edited, adapted, expanded, revised, or modified at the sole discretion of the College and its affiliates. I consent to use of the materials in connection with publicity, advertising, promotion, publication and any other purposes. I understand that the College and its affiliates may use the materials in any media or format it chooses, whether or not for profit, including without limitation television, radio, print, promotional materials and internet. I warrant and represent that this agreement does not in any way conflict with any existing commitment on my part. I agree that the College is not under any obligation to exercise any of the rights, licenses and privileges herein granted. I agree that no aspect of this agreement or participation in the event(s) makes me an employee of the College. I agree to release, waive, forever discharge, and covenant not to sue the College and its affiliates from and against any and all liability for any harm, injury, damage, claims, demands, actions, causes of action, costs, and expenses of any nature that I may have or that hereafter accrue to me, arising out of or relating to my participation in the event(s), the College’s or any affiliate’s exercise of rights granted by this agreement, including without limitation, claims for compensation, defamation, infringement, and invasion of privacy. In addition, I hereby hold harmless and indemnify the College and its affiliates from any and all liability, claims, actions, suits, losses and costs or related causes of action for damages arising out of or relating to my participation in the event(s), the College’s or any affiliate’s exercise of rights granted by this agreement, including without limitation, claims for compensation, defamation, infringement and invasion of privacy. I also understand that this agreement binds my heirs, executors, administrators, and assigns, as well as me. I agree that the materials my child may be edited, adapted, expanded, revised, exposed to or modified at the sole discretion of the College and its affiliates. I consent to use of the materials in connection with publicity, advertising, promotion, publication and any other purposesinfected by such illnesses by participation. I understand that the College such exposure or infection may result in personal injury, illness, permanent disability, and its affiliates may use the materials in any media or format it chooses, whether or not for profit, including without limitation television, radio, print, promotional materials and internetdeath. I warrant and represent also acknowledge that this agreement does by participating in programs there are unanticipated risks that include, but are not limited to, broken bones, torn ligaments or other injuries that could result in any way conflict with any existing commitment on my partphysical or emotional injury, paralysis or permanent disability, or death. I understand that these risks at The Tri-Cities Family YMCA may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Tri-Cities Family YMCA’s employees, volunteers, and program participants and their families. I voluntarily agree that the College is not under any obligation to exercise any assume all of the rightsforegoing risks and accept sole responsibility for any injury to myself (including, licenses and privileges herein grantedbut not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense) of any kind, that I may experience or incur in connection with my participation at the Tri-Cities Family YMCA. On my behalf, I agree that no aspect of this agreement or participation in the event(s) makes me an employee of the College. I agree to hereby release, waivecovenant not to sue, forever discharge, and covenant not to sue hold harmless the College Tri-Cities Family YMCA, its employees, agents, and its affiliates representatives, of and from and against any and the Claims, including all liability for any harm, injury, damageliabilities, claims, demands, actions, causes of actiondamages, costs, and costs or expenses of any nature that I may have or that hereafter accrue to me, kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Tri-Cities Family YMCA its employees, agents, and representatives, whether an illness, infection, or injury occurs before, during, or after participation at the Tri-Cities Family YMCA. By signing this document, I agree that if I am exposed to or infected by an illness or incur an injury during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence. I understand that in the interest to maintain an environment that is safe for members, employees, and visitors, the Tri-Cities Family YMCA reserves the right to prohibit access to its facilities to Registered Sex offenders. Any individual known to be listed on any state or national sexual offender registry will be denied access to the YMCA. I hereby give permission to trained medical professionals to administer emergency medical treatment to my child should illness or accident occur in my absence. If I have signed a separate general waiver of liability connected to my participation in at the event(s), the College’s or any affiliate’s exercise of rights granted by this agreement, including without limitation, claims for compensation, defamation, infringement, and invasion of privacy. In additionTri-Cities Family YMCA, I hereby agree that the terms of that waiver are wholly incorporated into this document and that the terms of this document are incorporated into the separate general waiver. I have read and understood this document and I agree to be bound by its terms.
