Common use of Cancellation Fees and Expenses Clause in Contracts

Cancellation Fees and Expenses. In the event this escrow terminates because of the non-satisfaction of any condition for a reason other than the default of the parties under this Agreement, the cancellation charges required to be paid by and to the Escrow Holder shall be borne equally by the Buyer and the Seller. In the event this escrow terminates because of a party’s default, the cancellation charges required to be paid by and to the Escrow Holder shall be borne by the defaulting party.
