C onstructive Resignation. A constructive resignation occurs and is effective when: A. An employee has been absent from duty without leave for ten (10) consecutive working days; and B. Ten (10) more consecutive days have elapsed without response by the employee after the mailing of a notice of resignation by the appointing authority to the employee at the employee’s last known address.
