Common use of Business Associate Agreements With Third Parties Clause in Contracts

Business Associate Agreements With Third Parties. HEALTHeLINK may enter into arrangements with one or more subcontractors as defined in 45 CFR Part 160.103, to perform certain HEALTHeLINK responsibilities as described in these Terms and Conditions. HEALTHeLINK shall enter into written agreements with such subcontractors, as required by 45 CFR Parts 164.308(b)(3), 164.314(a)(1), 164.502(e)(2), and 164.504(e)(1)(i), which written agreements shall contain the same restrictions and conditions on the use and/or disclosure of Protected Health Information that apply to HEALTHeLINK in Exhibit A. Participant acknowledges that such written agreement may differ in form, but not in substance, and shall be no less strict than the terms of Exhibit A.
