Bulletining and Filling of Positions. All vacancies and appointments for days or more shall be identified as temporary or permanent and bulletined over the entire System within each seniority group with a copy to the Chief Xxxxxxx. A position bulletined as temporary after having been continuously established for one year shall be bulletined as a permanent position, unless it is known at the time that the position will only continue to be required temporarily; if it is known prior to the expiration of one year that the position will be required permanently it shall be so bulletined except in case of sickness. When vacancies are bulletined, the bulletins shall be numbered consecutively each year and shall state whether permanent or temporary and the rate of compensation. Applications for vacancies must be filled within calendar days from date of bulletin and date of bulletin must coincide with date of first transmission. EXAMPLE: A bulletin transmitted on the first of the month would expire at midnight on the Employees applying for a position advertised may, if they so desire, cancel their application by wire within days from the date of advertising of the vacancy; should the senior applicant withdraw or not receive the appointment, the next senior qualified applicant who has not withdrawn will then be appointed without another bulletin being issued advertising the vacancy. After such period of days a request to cancel or withdraw application will not be considered and the position from which is transferring will be immediately advertised and cannot again bid in former position until it again becomes vacant. Senior applicant who has not withdrawn within days from date of vacancy bulletin must take the position within days of vacancy bulletin or go on the spare list. Once an application for a position advertised has been withdrawn, the withdrawal cannot be cancelled. When a vacancy occurs the appropriate officer will fill same by appointing the senior employee who is, in opinion, entitled to it, but this will not prevent any employee senior to the employee so appointed claiming right to the position under Article hereof, provided files protest within calendar days after the appointment has been bulletined as above. An employee declining to accept promotion in any instance does not forfeit right to the same or any other position may be entitled to under seniority when a vacancy occurs. An employee on leave of absence when a vacancy occurs will not be debarred from claiming position and receiving the appointment if entitled to it, providing that such claim is made within days from date of vacancy bulletin. Within calendar days after their appointment, regular swing employees may elect as their Headquarters Station one of the stations in which they perform regular swing relief service, and in such office will have the right to do temporary work in accordance with their seniority. The Headquarters Station will not be changed except in a case of a change in the consist of the swing position after a choice has been made or when a vacancy results in another employee being assigned to the swing position. The Company may select, without the necessity of posting and without regard to seniority, an employee from the bargaining unit to act in a capacity. In such instances, the employee's current rate of pay will be increased by for the period so assigned

Bulletining and Filling of Positions. All Vacancies in regularly assigned positions including temporary vacancies and appointments for of thirty (30) days or more shall be identified as temporary or permanent duration, seasonal positions and bulletined over the entire System within each seniority group with a copy to the Chief Xxxxxxx. A position bulletined as temporary after having been continuously established for one year newly-created positions of more than thirty (30) days duration, shall be bulletined as a permanent positionin their respective seniority groups within ten (10) days of such vacancies occurring or new positions being established, unless it is known at the time being understood that the position will only continue to temporary vacancies and new positions of indefinite duration need not be required temporarily; if it is known prior to bulletined until the expiration of one year thirty (30) days from the date created. When required, bulletins will be issued on Thursday of each week. Should Thursday be a general holiday, bulletins will be issued on the following working day. The bulletin shall show location, descriptive classification, rate of pay, hours of assignment of the position, assigned rest days, general description of duties, and, if temporary, the approximate duration, and shall be posted for five (5) calendar days in places accessible to all employees affected. Copies of all bulletins issued under this rule shall be furnished to the Local Chairperson. Employees, desiring such positions will, within the five (5) day period specified in Article forward to the designated officer their applications, in which they will clearly set forth their qualifications for the position. As evidence that an application has been submitted each applicant must forward a copy of their application to the Local Chairperson. In the event of no applications being received from employees with sufficient ability to perform the work, the proper officer of the Company will make the appointment. When the regularly assigned starting time of a position is changed two (2) hours or more, or assigned rest day or days are changed, such position shall be declared vacant and bulletined to the seniority group. The occupant of the position will be required permanently it permitted to exercise their seniority rights to any position they are qualified to fill, displacing a junior employee. Temporary vacancies and newly created positions of less than thirty days shall be so bulletined except filled, without necessity of bulletining, however, suitable advice notice will be posted and will be awarded to the senior qualified employee who makes application therefore within the first five (5) calendar days. In the application of this rule, regularly assigned employees will only be permitted to exercise their rights on temporary vacancies when an increase in case of sicknessrate is involved, or when it is known that the vacancy will be for more than five (5) working days.
