Common use of Build – Up Period Clause in Contracts

Build – Up Period. 2.10.1.1 Build-Up Period shall be the period of 6 months commencing on the First Delivery Date. In case CIL decides at its sole discretion to import, Build-up period shall be extended for a further period of six months for commencing supply of imported coal. During the Build-Up Period any compensation arising on account of short supply or short lifting, as per Clause -4.6 of this Agreement, shall not be payable by either Party. Supply of coal by Seller shall start only after the Purchaser’s power plant becoming ready to start lighting up the boilers, to be confirmed by the Purchaser to the Seller in writing with documentary evidence.
