Common use of Borrower Agent Clause in Contracts

Borrower Agent. Each Borrower appoints TriVascular its agent for purposes of the giving and receiving of any notice, and the agreement to any consent or waiver under this Agreement (TriVascular, in such capacity, the “Borrower Agent”). Any notice required by this Agreement to be delivered to any Borrower shall be deemed to have been delivered to such Borrower upon delivery of such notice to the Borrower Agent, and receipt of any notice by the Borrower Agent shall constitute receipt of such notice by each Borrower. Any notice or consent to be delivered hereunder by any Borrower shall be deemed to have been delivered by such Borrower upon delivery thereof by the Borrower Agent.
