Capital Requirements Clause Samples
The Capital Requirements clause sets out the obligations of a party, typically a financial institution, to maintain certain minimum levels of regulatory capital as required by law or regulatory authorities. This clause often applies to banks or lenders and may require them to adjust their operations or the terms of an agreement if changes in capital adequacy standards occur. Its core function is to ensure that the party remains compliant with evolving financial regulations, thereby protecting both parties from the risks associated with undercapitalization or regulatory breaches.
