Common use of Bituminous Coal Clause in Contracts

The annual average cost of bituminous coal (for purposes of the Base Escalator) and sulfur content (for purposes of Section 7.4) shall be based on the Form 423 reports filed with FERC by New Jersey utilities reporting the annual average cost of bituminous coal used by such New Jersey utilities.
