Beta Trials Sample Clauses
The BETA/TRIALS clause defines the terms under which a product or service is provided to users in a preliminary, non-final form for testing and feedback purposes. Typically, this clause clarifies that the beta or trial version may have limited features, may not be fully reliable, and is offered without the same guarantees or support as the final product. Its core function is to set user expectations, limit the provider's liability, and facilitate the collection of user feedback while minimizing risk during the testing phase.
Beta Trials. At any time prior to Certification of the Software Title, Microsoft may require that internal or public beta testing be conducted by or on behalf of Microsoft (the “Beta Trials”). Microsoft’s prior written approval, which may be withheld in Microsoft’s sole discretion, is required for any Beta Trials. All feedback provided by Microsoft to Publisher as a result of the Beta Trials is advisory in nature, and satisfactory feedback from the Beta Trials is not an indication that the Publisher Hosted Online Content will be approved following the Certification submission. Likewise, Beta Trial feedback may include information regarding violations of technical Certification requirements that could, if not addressed by Publisher, result in Certification failure.

If the Pre-Certification submission receives satisfactory results, Microsoft may require that internal and public beta testing be conducted by or on behalf of Microsoft (the "Beta Trials"). All feedback provided by Microsoft to Licensee as a result of the Beta Trials shall be advisory in nature, and satisfactory feedback from the Beta Trials is not an indication that the Online Features will be approved following the Certification submission. Likewise, Beta Trial feedback may include information regarding violations of Technical Certification Requirements that could, if not addressed by Licensee, result in Certification failure. The Beta Trial process shall be as further described in the Xbox Guide.
Beta Trials. You acknowledge and agree that certain products and services may be made available to Reseller and select NT-ware customers on a beta or trial basis. You acknowledge and agree that such beta products and services may contain bugs, defects, and errors, and that such products and services are not expected to function fully when made available to you. If such products and services are made available to you and you agree to use them, you understand that you are being offered the opportunity in exchange for, among other things, your evaluation of such beta products and services, including but not limited to, feedback on how such products and services may be improved, and a positive reference in a form to be agreed upon should the products and services satisfy your needs. Any feedback offered following a beta/trial use shall be confidential information of NT-ware and all rights including all Intellectual Property Rights in such feedback shall automatically upon creation belong to NT-ware. You further agree that NT-ware may use results and information from the trials such as Company name, statistics and number of devices. You will generally be notified at regular intervals before your trial is due to expire. If you do not purchase paid Services upon expiration of the trial you will not be able to continue to use the Services.
Beta Trials. ART shall provide ▇▇▇▇▇▇ Rights of Use and Frequency Coordination Services for a period of sixty (60) days without any obligation of ▇▇▇▇▇▇ to pay a Rights of Use fee for the frequency channels solely for the purpose of conducting two (2) BETA trials, with each trial consisting of one ▇▇▇▇▇▇ client and one link . The specific location of these trials shall be subject to the mutual agreement of ART and ▇▇▇▇▇▇. All costs associated with installation, including, but not limited to, site specific equipment and materials and field service during the BETA trial period shall be borne by ▇▇▇▇▇▇. ART shall bear its own personnel and travel-related costs associated with the site survey and installation in connection with the two BETA trials.
