Beta Software. If We identify the Software licensed to You as “Beta” Software, this section, Sections 11.1 (with all references toEvaluation Software” being replaced with “Beta Software”) and 11.3 apply. We have no obligation to You to further develop or publicly release the Beta Software. Support is not available for Beta Software. Upon Our request, You agree to provide feedback regarding testing and use of the Beta Software, including error or bug reports. You grant Us a perpetual, non-exclusive, royalty-free, worldwide license to use, copy, distribute and make Derivative Works and incorporate the feedback into any Product, at Our sole discretion. Upon receipt of a later unreleased version of the Beta Software or release by Company of a publicly released commercial version of the Beta Software, You must return, destroy, or delete permanently all earlier Beta Software that You have received from Us.

Beta Software. If the Service released to Customer has been identified by Tanium as "Beta Software," then the provisions of Section 11.1 (Evaluation Software) will apply, in addition to this Section 11.3. Customer is under no obligation to use any Beta Software; doing so is in Customer’s sole discretion. Because Beta Software can be at various stages of development, operation and use of the Beta Software may be unpredictable. Customer acknowledges and agrees that: (1) Beta Software has not been fully tested; (2) use or operation of Beta Software should not occur in a production environment; (3) Customer’s use of Beta Software will be for purposes of evaluating and testing new functionality and providing Feedback to Tanium; and (4) Customer will inform its personnel regarding the nature of the Beta Software. In addition, Tanium has no obligation to Customer to (1) further develop or release the Beta Software or (2) provide support for the Beta Software. If Tanium releases another version of the Beta Software, Customer will return or destroy all prior version(s) or release(s) of the Beta Software that it received from Tanium.

The purpose of releasing Beta software is to solicit feedback and help aPersona test new features or changes to existing features for a future release. aPersona has no obligation to You to further develop or publicly release the Beta Software since some aspects of a particular Beta release may or may not be suitable for commercial release. If requested by aPersona, You may provide feedback to aPersona regarding testing and use of the Beta Software, including error or bug reports. You agree to grant aPersona a perpetual, non-exclusive, royalty-free, worldwide license to use, copy, distribute, make derivative works and incorporate Your feedback into any aPersona product at aPersona's sole discretion. Beta Software. If the Software you are accessing with this agreement is a pre-commercial release or a beta version, then you understand that the Software is a pre-release, non-commercial version (collectively, “beta version”) and does not represent a final product of Syskit, Ltd. The Software may contain bugs, errors and other problems and should not be used in production environments. You understand that Syskit is not obligated to release the product, and ALL PRE-RELEASE OR BETA SOFTWARE IS PROVIDED ON AN “AS IS” BASIS AND SYSKIT, LTD. DISCLAIMS ANY AND ALL WARRANTIES OR LIABILITY TO THE CUSTOMER OF ANY KIND. Evaluation Software If you have been given an evaluation version (collectively, “not for sale” (“NFS”), “not for resale” (“NFR”), or “trial”), you may install and access the Software only for the purpose of demonstration, evaluation, and training purposes, and you agree that any output files (“reports” or “Software generated documentation”) are used only for internal, non-commercial, and non-production purposes for the period specified by Syskit (or, if not specified, for 21 days). You acknowledge that evaluation Software may not be fully functional. Any attempt to circumvent any expiration date is in violation of this XXXX and will immediately terminate your license to use the evaluation version. Notwithstanding anything else in this agreement, Syskit does not offer any warranty, indemnity or support for any evaluation Software. EVALUATION SOFTWARE IS PROVIDED “AS IS”. ACCESS TO AND USE OF ANY OUTPUT FILES CREATED WITH SUCH EVALUATION SOFTWARE IS ENTIRELY AT THE CUSTOMER’S OWN RISK. Subscription Edition If you have obtained or purchased from Syskit, or its authorized reseller, a right to use the Software for a specific period of time (a “subscription”) then all of the terms of use applicable to the Software set forth in this license agreement shall remain in force, except that the licensee’s right to use the Software shall not be perpetual, but shall instead be limited solely to the term of the subscription (“subscription term” as defined in 4.12). If Syskit does not receive the recurring subscription payment or cannot validate the license periodically, then the Software may become inactive without additional notice, until Syskit receives the payment or validates the license. A subscription edition requires your agreement to the subscription terms and to the other additional terms as noted in Section 6.
Beta Software. Viewpoint may make non-production versions of Software (“Beta Software”) available to Customer upon mutual agreement. All Beta Software will be clearly designated as Beta Software at the time it is made available to Customer. Beta Software is intended for testing and evaluation purposes only. Viewpoint may, but is not obligated to, provide Software Assurance for the Beta Software. Section 4.1 shall not apply to the Beta Software. Viewpoint may discontinue Beta Software at any time in Viewpoint’s sole discretion and has no obligation to make it generally available. Notwithstanding Section 9 or Section 10, Viewpoint will have no liability for any harm or damage arising out of or in connection with any Beta Software, including any obligation or liability with respect to Customer Data. Any configurations or Customer Data entered into Beta Software, and any customizations made to Beta Software by or for Customer, may be permanently lost. If Customer provides any comments, ideas, suggestions, or proposals relating to the Beta Software to Viewpoint (“Feedback”), Customer hereby irrevocably assigns all right, title, and interest in and to the Feedback to Viewpoint. Customer acknowledges and understands that it will not receive any compensation for providing Feedback.
