Beta Products. BETA PRODUCTS MAY NOT BE AUTHORIZED FOR USE BY THE GENERAL PUBLIC OR CERTIFIED AS MEETING RULES OR STANDARDS PROMULGATED BY GOVERNMENT OR OTHER AUTHORITIES IN YOUR JURISDICTION, AND RIM MAKES NO REPRESENTATION THAT SUCH AUTHORIZATION OR CERTIFICATION WILL BE OBTAINED. ACCORDINGLY, YOU AGREE THAT THE BETA PRODUCTS ARE NOT, AND MAY NOT, BE OFFERED FOR SALE OR LEASE, OR SOLD OR LEASED, UNTIL SUCH AUTHORISATION IS OBTAINED. BETA PRODUCTS ARE NOT INTENDED FOR USE IN ANY PRODUCTIVE OR OTHER ENVIRONMENT WHERE YOU ARE RELYING ON THE PERFORMANCE OF THE BETA PRODUCTS. THE BETA PRODUCTS ARE PRE-COMMERCIAL RELEASE VERSIONS OF SOFTWARE, SERVICES AND RIM PRODUCTS AND ARE NOT INTENDED TO REPRESENT OR PERFORM IN THE SAME MANNER AS COMMERCIAL PRODUCT OR SERVICES, AND YOU SHOULD ENSURE THAT YOU REGULARLY BACK-UP ANY DATA USED WITH SUCH MATERIALS. IN ADDITION, THE BETA PRODUCTS CONTAIN FEATURES, FUNCTIONALITY OR APIS FOR SOFTWARE OR SERVICES THAT ARE NOT YET COMMERCIALLY AVAILABLE. YOU ACKNOWLEDGE THAT SUCH BETA PRODUCTS, OR ANY PORTION THEREOF, MAY NOT BE ANNOUNCED OR MADE COMMERCIALLY AVAILABLE BY RIM IN THE FUTURE, OR MAY BE MADE AVAILABLE WITH SIGNIFICANT CHANGES, AND RIM HAS NO EXPRESS OR IMPLIED OBLIGATION TO YOU TO ANNOUNCE OR MAKE ANY OF SUCH SOFTWARE OR SERVICES, BETA PRODUCTS OR ANY PORTION THEREOF AVAILABLE. YOU ACKNOWLEDGE AND AGREE THAT ALL TESTING, EVALUATION AND DEVELOPMENT YOU CONDUCT WITH RESPECT TO THE BETA PROUCTS AND RELATED SOFTWARE AND SERVICES IS DONE ENTIRELY AT YOUR OWN RISK.
Beta Products. If the Software is identified as pre-commercial, evaluation, pilot, "alpha", or "beta" software ("Beta Software"), the license rights set out above with respect to Your use of such Beta Software apply only for the time period authorised by Magnet Forensics ("Beta Period") and solely to the extent necessary to enable You and the Users to test and provide Feedback to Magnet Forensics regarding the Beta Software. Such license will automatically terminate upon the expiration of the Beta Period, which period may be extended or terminated by Magnet Forensics at any time, in its sole discretion, but, unless You are in breach of this Agreement, Magnet Forensics will use commercially reasonable efforts to provide You with prior notice of any change to the duration of the Beta Period. Notwithstanding the Beta Period, You acknowledge and agree that Magnet Forensics may include technical measures in the Beta Software that renders it inoperable after a specified period of time and You agree that You will not circumvent such technical measures. In consideration of the grant of license for the Beta Software, You agree that You will provide Magnet Forensics with Feedback on Beta Software as Magnet Forensics reasonably requests without any compensation, and that Section 2.9 will apply to such Feedback.
Beta Products. In the event that there is any functionality labelled “Beta” on the Xxxxxx Order Form, such functionality is provided “AS IS” WITHOUT ANY EXPRESS, OR IMPLIED WARRANTY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHER WARRANTIES ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY INVOICE CLOUD AND ITS LICENSORS AND PAYMENT PROCESSORS. INVOICE CLOUD’S AGGREGATE LIABILITY WITH RESPECT TO SUCH FUNCTIONALITY SHALL BE UP TO AND NOT EXCEED $10.
Beta Products. Despite anything to the contrary in this Agreement, the Customer acknowledges that: (a) the Customer has the sole discretion whether to use any Beta Products, (b) Beta Products may not be supported and may be changed at any time, including in a manner that reduces functionality, (c) Beta Products may not be available or reliable, and (d) ONS provides Beta Products “as-is” and will have no liability arising out of or in connection with Beta Products.
Beta Products. CUSTOMER ACKNOWLEDGES AND AGREES THAT: (I) ANY PRE-COMMERCIAL RELEASE OR EVALUATION VERSIONS OF BLACKBERRY SOFTWARE OR BLACKBERRY SERVICES MADE AVAILABLE TO CUSTOMER BY BLACKBERRY UNDER ADDITIONAL TERMS AND CONDITIONS ("BETA PRODUCTS”) MAY NOT BE AUTHORIZED FOR COMMERCIAL USE OR CERTIFIED BY GOVERNMENT OR OTHER AUTHORITIES AND BLACKBERRY MAKES NO REPRESENTATION THAT SUCH AUTHORIZATION OR CERTIFICATION SHALL BE OBTAINED OR THAT THE BETA PRODUCTS SHALL BE COMMERCIALLY RELEASED OR RELEASED WITHOUT CHANGES; (II) BETA PRODUCTS ARE NOT INTENDED FOR USE IN ANY PRODUCTIVE OR OTHER ENVIRONMENT WHERE CUSTOMER IS RELYING ON THE PERFORMANCE OF THE BETA PRODUCTS; (III) BETA PRODUCTS ARE NOT INTENDED TO REPRESENT OR PERFORM IN THE SAME MANNER AS COMMERCIAL SOFTWARE OR SERVICES AND CUSTOMER SHOULD ENSURE THAT IT REGULARLY BACKS UP ANY DATA USED WITH SUCH MATERIALS; AND (IV) ALL TESTING AND EVALUATION THAT IT CONDUCTS OF BETA PRODUCTS AND RELATED SOFTWARE AND SERVICES IS DONE ENTIRELY AT CUSTOMER’S OWN RISK.
Beta Products. Jolt may from time to time make available, in "beta" mode, new versions of the Service and/or new Features that are still undergoing internal development and testing (each, a "Beta Product"). Beta Products may be time- limited, feature-limited, and/or functionality-limited. Jolt may also decide to only make a Beta Product available to closed list of Service users. If Jolt makes a Beta Product available to you, you may use it on the following conditions: (i) you only use it for evaluation purposes; (ii) you comply with any specific guidelines issued by Jolt in respect of the Beta Product, which may include a requirement that you provide Feedback (defined below) and participate in surveys about the Beta Product; and (iii) you do not publicize the fact that there is a Beta Product, and you do not show, display, or otherwise make available the Beta Product to any other person (which includes, without limitation, making such disclosures to traditional or social media). For the avoidance of doubt, the provisions of this Agreement that apply to the Service (such as Usage Restrictions in Section 5 and Disclaimers in Section 14).
Beta Products. Customer acknowledges and agrees that: (i) Beta Products may not be authorized for commercial use or certified by government or other authorities and BlackBerry makes no representation that such authorization or certification shall be obtained or that the Beta Products shall be commercially released or released without changes; (ii) Beta Products are not intended for use in any productive or other environment where Customer is relying on the performance of the Beta Products; (iii) Beta Products are not intended to represent or perform in the same manner as commercial software or services and Customer should ensure that it regularly backs up any data used with such materials; and (iv) all testing and evaluation that it conducts of Beta Products and related software and services is done entirely at Customer’s own risk. The Beta Products shall be made available for a period of up to ninety (90) days, unless stated otherwise by BlackBerry in writing. The period of availability of the Beta Products may be extended or terminated by BlackBerry at any time in its sole discretion. BlackBerry may require Customer to promptly return the evaluation or beta copies of the Beta Products and remove all copies of such Beta Products from its systems.
Beta Products. At StorageTek's request, through a [*] purchase order, SSI shall furnish to StorageTek or its Affiliates for beta testing by StorageTek, its Subsidiaries, Distributors and End Users, beta products for all proposed Substitutes and new Co-branded Products in quantities as mutually agreed (the "BETA UNITS"). The Beta Units will not be required to be returned to SSI unless such products fail.
Beta Products. C1 shall provide to PwC advance copies and beta releases of all C1 Software as soon as reasonably possible.
Beta Products. We may designate enhancements to a Product or a new Product as "Beta Product." Such Beta Product will not be ready for use in a production environment and its operation may be unpredictable and lead to erroneous results. You are under no obligation to use a Beta Product. If you choose to use a Beta Product, you agree the Beta Product (i) is experimental and has not been fully tested; (ii) may not meet your requirements; (iii) use or operation may not be uninterrupted or error free and is for purposes of evaluating and testing the product and providing feedback to us. You agree to report promptly to us any errors or other deficiencies in the Beta Product and will hold all information relating to use and performance of the Beta Product in strict confidence and not disclose such information to any unauthorized third parties. Use of any Beta Product is otherwise subject to these Terms of Use. NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS OF USE, ALL BETA PRODUCT IS PROVIDED "AS-IS" AND "AS-AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. You hereby waive any and all claims, now known or later discovered, that you may have against us and our suppliers and licensors arising out of your use of any Beta Product.
